Abstract
Poreznopravno određivanje kapitalne dobiti najsloženiji je proces oporezivanja prihoda. Diskusije se vode oko pitanja o usklađivanju kapitalne dobiti sa široko shvaćenim i postojećim zakonski definiranim prihodima ili bi se kapitalna dobit trebala oporezivati kao zasebna poreznopravna kategorija. Činjenica da kapitalna dobit nastaje kao posljedica određene gospodarske aktivnosti nije upitna. Porezni obveznici, obavljaju svoju gospodarsku djelatnost s ciljem ostvarenja prihoda te time stvaraju određenu financijsku obvezu prema državi.
