Abstract Javna nabava je zasigurno značajan segment gospodarstva svake zemlje kroz koji se na nabavu roba, radova i usluga potrebnih za redovito poslovanje i obavljanje javnih i sektorskih djelatnosti, troši znatan javni novac. Stoga je važno da se svaki dio postupka javne nabave detaljno regulira kako bi se ti postupci provodili transparentno i učinkovito uz maksimalno moguće sprječavanje koruptivnih i drugih nezakonitih radnji. Kroz postupke javne nabave obveznici Zakona o javnoj nabavi u svom svakodnevnom poslovanju nabavljaju različitu robu, usluge i/ili radove, a za što koriste javni novac. Iz godine u godinu raste iznos javnih sredstava koja se koriste u javnoj nabavi zbog čega se pohlepni pojedinci koji u ime javnih naručitelja sudjeluju u postupcima javne nabave, upuštaju u razne nezakonite radnje nastojeći sebi priskrbiti imovinsku ili drugu korist. Stoga je razvidno da zakonodavno-pravnim i institucionalnim okvirom javne nabave treba zaštiti ta javna sredstva i poštene sudionike postupaka javne nabave. Kako su temeljni ciljevi javne nabave: ostvarenje tržišnog natjecanja, učinkovitost postupka i suzbijanje korupcije, transparentnost i adekvatna pravna regulativa je od suštinskog značaja za osiguranje poštenih i otvorenih postupaka nabave te za njihovu učinkovitost i za prevenciju korupcije i drugih kaznenih i prekršajnih djela. Dosljednom primjenom Zakona o javnoj nabavi, Kaznenog zakona i Zakona o zaštiti tržišnog natjecanja te učinkovitim radom tijela državne uprave nadležnog za politiku javne nabave u Republici Hrvatskoj i učinkovitim radom Državne komisije za kontrolu postupaka javne nabave, moguće je ostvariti temeljne ciljeve javne nabave. Jasan i nedvojben zakonodavni okvir javne nabave i njen efikasan institucionalni okvir preduvjet su kvalitetne pravne zaštite u postupcima javne nabave, a time i veće pravne sigurnosti svih sudionika u javnoj nabavi.
Abstract (english) Public procurement is certainly an important segment of the economy of every country through which considerable public money is spent on the procurement of goods, works and services necessary for regular business operations and the performance of public and sectoral activities. Therefore, it is important that every part of the public procurement procedure is regulated in detail in order to carry out these procedures transparently and efficiently with the maximum possible prevention of corrupt and other illegal actions. Through public procurement procedures, the obligees of the Law on Public Procurement procure various goods, services and/or works in their daily operations, for which they use public money. Year after year, the amount of public funds used in public procurement grows, which is why greedy individuals who participate in public procurement procedures on behalf of public clients, engage in various illegal actions, trying to obtain financial or other benefits for themselves. Therefore, it is clear that the legislative-legal and institutional framework of public procurement should protect these public funds and honest participants in public procurement procedures. As the fundamental goals of public procurement are: the achievement of market competition, the efficiency of the procedure and the suppression of corruption, transparency and adequate legal regulation are of essential importance for ensuring fair and open procurement procedures and for their effectiveness and for the prevention of corruption and other criminal and misdemeanor acts. Through the consistent application of the Law on Public Procurement, the Criminal Law and the Law on the Protection of Market Competition and the effective work of the state administration body responsible for public procurement policy in the Republic of Croatia and the effective work of the State Commission for the Control of Public Procurement Procedures, it is possible to achieve the fundamental goals of public procurement. A clear and unequivocal legislative framework for public procurement and its efficient institutional framework are a prerequisite for quality legal protection in public procurement procedures, and thus greater legal security for all participants in public procurement.
