Abstract Osiguranje podrazumijeva prijenos rizika s osiguranika na osiguratelja koji nadoknađuje štete onima kod kojih su one nastale te ih raspodjeljuje na sve pripadnike zajednice rizika. Društva za osiguranje prodaju sigurnost, odnosno preuzimaju na sebe rizike kojima su izloženi poduzeća i stanovništvo, a zauzvrat zahtijevaju plaćanje određene naknade. Međutim, i društva za osiguranje u svom su poslovanju izložena raznim rizicima, između ostalih i operativnom riziku, koji čini glavnu temu ovog rada. Osiguravajuća društva dužna su provoditi proces upravljanja rizicima, tj. znanstveno pristupiti problemu bavljenja čistim rizicima. Način i regulatorni okvir upravljanja rizicima razlikuju se od zemlje do zemlje. To se očituje u ulozi supervizora, tehnikama procjene rizika, vrstama rizika kod određivanja solventnog kapitala, kalkulacijama kapitala i sl. Rad istražuje razlike u upravljanju rizicima u zemljama Europske unije i Sjedinjenim Američkim Državama, s pomoću komparativne analize Solvency II sustava i RBC modela. Provedeno istraživanje pokazalo je da bi se u narednim godinama trebalo više orijentirati na operativni rizik. Na tome bi naročito trebao poraditi SAD koji ga danas ni ne razmatra kao zasebnu kategoriju. Za primjer bi im mogla poslužiti EU sa svojim Solvency II sustavom kojim je poboljšala regulatorni okvir osigurateljne djelatnosti, uspostavila kvalitetnija i čvršća pravila solventnosti te pridala veliku važnost operativnom riziku. S druge strane, iako se odnedavno počinje razmatrati način uključivanja operativnog rizika u RBC formulu te više vremena posvećivati njegovom upravljanju, formula NAIC-a još uvijek ne uključuje operativni rizik. Solvency II režim pozitivno utječe na regulaciju osiguranja u SAD-u, što se vidi na njihovom projektu Inicijative modernizacije solventnosti, a koji se s obzirom na trenutne nedostatke sustava smatra izrazito korisnim.
Abstract (english) Insurance involves risk transfer from the insured to the insurer who compensates damages to those in which they are incurred and distributes risks on all members of the risk community. Insurance companies sell security, they assume the risks of entities and individuals, and in return they demand certain fees. However, during theirs activities, the insurance companies are also exposed to various risks, including the operational risk, which is the main theme of this paper. Insurance companies are obliged to implement the risk management process, they must approach the problem of dealing with clear risks scientifically. The method and regulation of risk management varies from country to country. This is reflected in the role of supervisor, risk assessment techniques, types of risks included in determing solvency capital requirements, capital calculations etc. The paper analyzes differences in risk management in the European Union and the United States, using comparative analysis od Solvency II system and RBC model. Research showed that in the coming years it should be more focus on operational risk. This is primarily related to US where operational risk is not considered as a separate category. As example, they could use EU with their Solvency II system, which has improved regulatory framework for insurance, establish better and stronger solvency rules and has attached great importance to operational risk. On the other hand, although recently there are some considerations of including operational risk in RBC formula and more time is dedicated to its management, NAIC formula still does not include operational risk. Solvency II regime has a positive impact on the regulation of insurance in US, which is reflected in their Solvency Modernization Initiative and which given the current disadvatages of the system is considered extremely useful.
