Abstract
U radu se prezentiraju osnovna obilježja arbitražnog postupka uz poseban osvrt na arbitražu u trgovačkim sporovima. Arbitraža je sredstvo za brzo, ekonomično i pošteno rješenje mnogih nesporazuma koji se javljaju u svakodnevnom odvijanju poslova. Ona nije niti može biti lijek protiv svih bolesti u trgovačkom poslovanju, ali možemo je smatrati jednim od poželjnijih sredstava koja trgovcima stoje na raspolaganju za uklanjanje konflikata među poslovnim subjektima. Pojedine faze arbitražnog postupka prikazane su u odnosu sa nacionalne propise i bilateralne i multilateralne konvencije koje se tiču arbitraže i čine cjelinu arbitražnog prava. Rad je oplemenjen i prikazom arbitražnih postupaka iz prakse hrvatskih trgovačkih društva i to kako u postupcima sa, tako i u postupcima bez međunarodnog obilježja. Nadam se da će ovaj rad predočiti prednosti arbitražnog postupka u odnosu na ostale alternativne načine rješavanja sporova i biti poticaj mnogim subjektima u Republici Hrvatskoj da se intenzivnije počnu baviti ovim pravnim područjem
Abstract (english)
The paper presents the main features of the arbitration procedure, with particular reference to arbitration in commercial disputes. Arbitration is an instrument for rapid, cost-effective and fair solution to the many misunderstandings arising out of everyday business transactions. It is not and can not be panacea in the vending business, but can be considered one of the most desirable as well as available instruments for the interbusiness conflict solution. Some phases of the arbitration procedure are shown in comparison with the national regulations and bilateral and multilateral conventions relating to arbitration making arbitration law completeness. The work is improved and display arbitration proceedings from the practice of Croatian commercial companies both in dealings with and in the proceedings without an international element. I hopefully this paper will present the advantages of arbitration proceedings in relation to other alternative dispute resolution, and be an incentive for many entities in the Republic of Croatia to intense their engagement in this legal area.
