Abstract
Ugovor o djelu razlikuje se od ugovora o radu. Oba su regulirana i prepoznata u zakonodavstvu Republike hrvatske, pa je tako ugovor o djelu reguliran odredbama Zakona o obveznim odnosima. Ovdje se radi o ugovoru građanskog odnosno obveznog prava. U takvom ugovor, izvođač se obvezuje na obavljanje određenog posla, dok se naručitelj obvezuje na isplati naknade izvođaču za obavljen posao. Može se reći da je ugovor o djelu konsenzualan i dvostrano obvezan, te naplatni i neformalni ugovor. Postavlja se pitanje o (ne)dovoljnoj regulaciji ugovora o djelu uslijed rastuće gig ekonomije. Naime, gig ekonomija podrazumijeva robno-novčanu razmjenu na relaciji pojedinac-kompanija, i to putem digitalnih platformi. Riječ nije uvijek o kratkoročnim poslovima i plaćanju po zadatku. Osnovni problem takvih poslova jesu nesigurnost i nepredvidljivost takvog načina rada. Međutim, Sud pravde Europske unije uspostavio je razne kriterije, te se Direktom o pisanoj izjavi navode specifičnosti vezane uz poslodavca i radnika, a koji se tiču uvjeta koji se dalje primjenjuju na takve ugovore.
Abstract (english)
A service contract is different than an employment contract. Both of them are regulated by the Republic of Croatia law, thus a service contract is a regulated law of mandatory relationships. This is a contract for a citizen's elementary right. In this contract, the signing party agrees to provide service/work while the employer agrees to pay accordingly for the done work. It can be said that the service contract is a two- sided consensual agreement for payment, thus making it an informal contract. We can only ask the question about the lack of regulations when it comes to this contract in the rise of the “gig economy”. The gig economy encompasses goods for money exchange in relation to individual-company through digital platforms. It’s not always about short- term jobs and project-based compensations. The biggest issue about these types of jobs is the lack of security and unreliability. However, the European Union Court of Justice established various criteria, thus directly after a written statement the terms need to be specified and tied to the employee-employer relationship, which would apply to these types of contracts in the future.
