Abstract
Kao odgovor na teški slučaj seksualnog zlostavljanja i ubojstva jedanaestogodišnjeg dječaka, federalno zakonodavstvo Sjedinjenih Američkih Država 1994. godine donosi prvi federalni zakon o registraciji počinitelja seksualnih delikata - Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act. Wetterlingov zakon poslužio je kao temelj za donošenje velikog broja novih zakona i mjera ograničenja usmjerenih na počinitelje seksualnih delikata s ciljem zaštite zajednice te prevencije novih slučajeva seksualne viktimizacije. Takva praksa nije se zadržala samo u SAD-u, već su i brojne druge zapadne zemlje krenule s uvođenjem donekle sličnih politika. Unatoč važnim ciljevima, kritičari registracije počinitelja seksualnih delikata i popratnih mjera ograničenja smatraju da su pretpostavke koje se nalaze u njihovoj podlozi pogrešne te da iz tog razloga one nisu uspješne u prevenciji. Uzevši u obzir i brojne kolateralne posljedice s kojima se registrirane osobe suočavaju, sve veći broj stručnjaka ističe potrebu za provođenjem reformi politika registracije. Cilj je ovog rada prikaz povijesti razvoja politika registracije seksualnih delikata te opis najvažnijih zakona koji reguliraju proces registracije na globalnoj i regionalnoj razini. Također, u radu se daje prikaz istraživanja uspješnosti politika registracije u prevenciji novih slučajeva seksualne viktimizacije te istraživanja kolateralnih posljedica s kojima se suočavaju registrirane osobe i njihove obitelji, te se zaključno daje prikaz u literaturi najčešće spominjanih prijedloga za reformu postojećih politika.
Abstract (english)
Responding to a serious case of sexual abuse and murder of an eleven-year-old boy, the US Congress passed the first federal law on the registration of sexual offenders – the Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Act. This law served as the basis for passing a series of new laws and restrictive measures aimed at sexual offenders with the aim of protecting the community and preventing new cases of sexual victimization. These policies are not only typical in the USA, as many western countries also started to introduce somewhat similar laws and policies. Despite their well-intentioned goals, the critics of sex offender registries and restrictive measures believe that they are based on myths and faulty assumptions and that for this reason they are not successful in prevention. Taking into account the numerous collateral consequences that registered offenders face, a growing number of experts emphasize the need for reforms. The aim of this paper is to present the historical development of sex offender registartion policies and to describe the most important registration laws at global and regional level. Attention was also paid to the available research on the effectivness of registration policies in preventing new cases of sexual victimization and research on the collateral consequences that registered offenders and their families face. The paper is concluded with presenting the most frequently mentioned proposals for reforming the existing registration policies.
