The state of NGA fixed broadband infrastructure in the Republic of Croatia is not at a satisfactory level and from the present point of view it is necessary to provide NGA access for 65% -70% of the population of the Republic of Croatia. These are predominantly rural areas where operators have no enough commercial interest in investing, therefore the National framework is approved at national level as an authorized state aid scheme. Under this program, electronic communications operators are designated beneficiaries of state aid funds (grants from European Union funds). The most economically advantageous offer (AET) concept is the basic concept of selecting an operator within the investment model “A" (Private DBO) as well as selecting technological solutions to support implementation of broadband infrastructure development projects in Croatia in the up-coming period (until 2023). This concept is formally and legally defined within the state aid scheme as a procedure in which operators are selected in accordance with the open procedure of the Public Procurement Act, in which one of the basic selection criteria is the required absolute amount of state aid. The Ministry of Regional Development and EU Funds without a clear explanation, assuming the preservation of the concept of market competition, changed the concept within the published Public Call for the Construction of NGA Networks and stipulated that the operators should be selected according to the so-called 'competitive procedure' in the pre-selection phase. In the aforementioned concept the prevailing selection criterion is the "relative" amount of the state aid amount which eliminates the element of "price" (absolute amount), which does not fit completely with the principle of efficient use of grants. In the previous period operators had the opportunity to submit their bids for 65 approved projects under investment model “A” within which they had to submit the necessary financial parameters and the relative amount of their own and state aid funds according to the given concept of technological neutrality based on estimated costs and revenues. Also, in their bids they had to confirm that according to the estimated parameters they would provide NGA access to all potential user types in the project area, that is for a minimum of 78% of private users provide "symmetrical" access. From the aforementioned, it is necessary that the operators in the forthcoming period through state aid funds mostly build exclusively optical (FTTH) infrastructure, as an open network on wholesale level. Furthermore, this default requirement of "symmetry" in the concept of AET is a qualitative technological criterion by which at the national level has created the preconditions for technological advancement in the fixed broadband market and for the further development of society in the direction of digitalization.
