Abstract
Cilj ovog rada jest propitati genezu i značenje ideje i koncepcije ljudskih prava. Koncepcija ljudskih prava jedna je od središnjih tema moderne i suvremene filozofije politike. Osnovna svrha ljudskih prava je zaštita ljudske autonomije u svijetu od političke, pravne i socijalne samovolje, nasilja i proganjanja. U radu je obrađena geneza ljudskih prava od rimskog prava pa do Opće deklaracije o pravima čovjeka. Zatim je prikazana razlika između privatne i javne moralnosti te njihov odnos naspram ljudskih prava. Na to se nadovezuje problem univerzalnosti ljudskih i kulturnog relativizma. S obzirom na to da Opća deklaracija o pravima čovjeka nije zakonski obvezujući dokument, što znači da ga jedna država nije obvezna ratificirati te da postoji mnogo različitih kultura po cijelom svijetu i da se te kulture drastično međusobno razlikuju, postavlja se pitanje kako je moguće da su u ovakvom svijetu ljudska prava univerzalna, odnosno da obuhvaćaju svakog pojedinog čovjeka. Izložene su i neke kritike prvo prirodnih prava, a zatim i same koncepcije ljudskih prava. Na kraju rada analizirano je jedno poglavlje iz udžbenika etike koje govori o ovoj temi.
Abstract (english)
The purpose of this thesis is to question the origin and meaning of the human rights theory. The theory of human rights is one of the main subjects of the modern contemporary political philosophy. The main purpose of human rights is to protect the human autonomy from political, legal and social violence and prosecution. The thesis examines the origins of human rights going from Roman law to the Universal Declaration of Human Rights. The thesis also depicts the differences between private and public morality which leads to the problems of human rights universality and cultural relativism. Considering that the Universal Declaration of Human Rights isn't legally binding and that there are many different cultures in the world, a question poses itself – how is it possible that there are universal human rights embracing every human being in the world? The thesis also deals with the critique of natural rights, following with a critique of human rights. Lastly a chapter from an ethics textbook is analysed that deals with the subject of human rights.
