Abstract
U ovom diplomskom radu analizira se utjecaj Opće uredbe o zaštiti podataka na arhive i arhivsku djelatnost. Na početku rada dan je kratak povijesni pregled razvoja prava na zaštitu podataka koji završava stupanjem na snagu Opće uredbe o zaštiti podataka. Zatim slijede općenite informacije o Uredbi s definicijama najvažnijih pojmova i opisom svih prava iz Uredbe koja ispitanicima pružaju veću kontrolu nad svojim osobnim podacima. Budući da Uredba dopušta da se neki njezini dijelovi pobliže definiraju u nacionalnom zakonodavstvu, jedno se poglavlje bavi hrvatskim zakonima i pravilnicima koji se u potpunosti ili barem djelomično odnose na zaštitu osobnih podataka. Nakon toga slijedi analiza utjecaja Uredbe na arhive i njihovu djelatnost u kojoj se između ostalog razmatraju različiti aspekti Uredbe, kao što su načela obrade, odstupanja od prava ispitanika i zaštitne mjere u njihovom međuodnosu s arhivistikom. Na kraju rada prikazani su utjecaji i primjena Opće uredbe o zaštiti podataka na primjerima službenih internetskih stranica arhiva u Hrvatskoj.
Abstract (english)
This thesis analyses the impact of the General Data Protection Regulation (GDPR) on archives and archival services. A brief historical overview of the development of the data protection laws is given at the beginning of the thesis, ending with the entry into force of the General Data Protection Regulation. This is followed by general information about GDPR with definitions of the most important terms and a description of all the rights under GDPR that give data subjects more control over their personal data. Since GDPR allows some of its parts to be more fully defined in the national legislation, one chapter deals with Croatian laws and bylaws that completely or at least partially relate to the protection of personal data. This is followed by an analysis of the impact of GDPR on archives and their activity, which, among other things, discusses various aspects of GDPR, such as processing principles, derogations from data subject’s rights and safeguards in their interrelation with archival science. At the end of the thesis, the impacts and application of the General Data Protection Regulation on the examples of official websites of archives in Croatia are presented.
