Abstract
Suverenitet je obilježje državne vlasti koja je najviša iznutra, a neovisna prema van. Pojam suvereniteta nacionalne države u zraku se temelji na Pariškoj i Čikaškoj konvenciji. Koncept teritorijalnog suvereniteta temeljno je polazište na kojem je zasnovano gotovo cijelo međunarodno zračno pravo. Glavni problem definicije nacionalnog suvereniteta u zraku jest što još uvijek niti jedna država pa ni međunarodna organizacija nije zakonski definirala granicu između zračnog prostora i svemira, tj. vertikalnu granicu suvereniteta u zraku. Zaštita nacionalne sigurnosti bila je jedan od glavnih razloga za uspostavljanje koncepta potpunog i isključivog suvereniteta nad zračnim prostorom, a u ime te sigurnosti države su koristile prekomjernu vojnu silu i tako borbeno djelovali prema civilnim putničkim zrakoplovima koji su se najčešće greškom našli u zračnom prostoru te države što je rezultiralo velikim ljudskim žrtvama. Kako bi se smanjila mogućnost države da svoju vojnu silu rabi nekontrolirano međunarodne organizacije i pojava globalizacije ograničavaju suverenitet država.
Abstract (english)
Sovereignty is a characteristic of the State which has the legitimate power to govern, and is free from external control. The concept of sovereignty in the air was mostly developed by the Paris and Chicago Conventions, and State sovereignty over its territorial airspace is the basic principle underlying the whole system of International Air Law. The biggest issue regarding State sovereignty is that there is no international agreement on the vertical limit of State sovereignty, the boundary between territorial airspace and outer space. The protection of national security was one of the major reasons for establishing the concept of complete and exclusive sovereignty over the airspace, and there were many civil aircrafts which were shot down because they were considered as representing a threat for the national security of sovereign states. To control the State's ability to use force the State sovereignty is being limited by international organizations and by the globalization.
