Abstract
Rad se bavi obilježjima braka u ranom novom vijeku, a koja su u stvarnosti još uvijek bila srednjovjekovna i uzrokovala nestabilnost u društvu. Naime, način i običaji sklapanja braka su bili raznovrsni, a nije postojala niti evidencija o sklopljenim brakovima, što je dovodilo do tajnih brakova i konkubinata, prisutnih čak i među svećenstvom. Suočena s izazovima reformacije, Crkva je na koncilu u Tridentu (1545.-1563.) donijela reforme koje nalažu da je brak valjan samo ako je sklopljen u crkvi, pred svećenikom i registriran u matičnoj knjizi vjenčanih. Tridentske reforme mogu se smatrati prijelomnom točkom u povijesti braka, ali i discipliniranja društva. Naime, svjetovne vlasti su pod izgovorom provođenja reformi zapravo preuzimale nadležnost nad pitanjima braka i obitelji od Crkve te crkvene odredbe prilagođavale svojim potrebama. Premda se činilo da se Crkva i država nalaze na suprotnim strana kada je riječ o politici i društvu, ipak su pronašle zajednički interes – discipliniranje pojedinca i društva kroz instituciju braka.
Abstract (english)
This paper deals with the characteristics of marriage in the early modern period, which in reality was still medieval and caused instability in the society. The manner and customs of marriage were varied, and there has been no record of marriages, leading to secret marriages and concubinage, present even among the clergy. Faced with the challenges of the Reformation, the Church at the Council of Trent (1545-1563) adopted reforms requiring that marriage is valid only if it is concluded in the church, in front of the priest and registered in the church register of marriages. Trent reforms can be considered as a fracture point in the history of marriage, but also in disciplining society. The secular authorities under the pretext of reforms actually assumed jurisdiction over matters of marriage and the family from the Church and adapted ecclesiastical provisions to their needs. Although it seemed that the Church and state are on opposite sides when it comes to politics and society, they have found a common interest - the disciplining of the individual and society through the institution of marriage.
