Abstract
Cilj završnog rada je opisati ugovor o pomorskoj agenciji, odnosno na koji način se taj ugovor koristi u praksi, tko su njegove ugovorne strane, kako navedeni ugovor može nastati, u kojim oblicima se može pronaći i objasniti na koji način prestaje te koliko traje. Ugovor o pomorskoj agenciji obuhvaća najvažnije stavke o pomorsko-agencijskom poslovanju, a to su obveze agenta i obveze nalogodavca. Sam ugovor objašnjava pravni posao između ugovornih strana. Bitno je znati da ugovor o pomorskoj agenciji ima svoje bitne elemente i ugovorne odredbe (klauzule) gdje ugovorne strane dogovorom mogu mijenjati, brisati i nadodati druge ugovorne odredbe (klauzule) u ugovoru. Rad će se osvrtati i na standardne ugovore koji su često korišteni u samoj praksi, a najbitniji za znati je Ugovor o općoj agenciji iz 2017. godine za kojeg se smatra da je budućnost ugovora o pomorskoj agenciji te privikavanje na taj ugovor još uvijek traje.
Abstract (english)
The aim of this research paper is to describe a maritime agency contract, how the contract is used in practice, who are its contracting parties, how the said contract may arise, in what forms can it be found, and explain how it ends and how long it lasts. The contract of a maritime agency covers the most important items in the maritime agency business, these being the obligations of the agent and the client. The contract itself explains the legal work between the contractors. It is important to know that a maritime agency contract has its essential and contractual provisions (clauses), where the contracting parties may, by agreement, amend, remove, and add other contractual provisions (clauses) in the contract. The paper will also look at the standard contracts that are often used as common practice, as well as the 2017 General Agency Agreement which is currently being introduced and is considered to be the future standard for the shipping agency contract.
