Abstract
Polaganje podmorske kabelske infrastrukture i cjevovoda predstavlja složen proces gdje se isprepliću razni subjekti koji mogu biti javni i privatni. Stoga je pravilna regulacija zakonskim i podzakonskim aktima neophodna iz razloga što se radi o posebnim morskim prostorima, odnosno o pomorskom dobru kao dobru od općeg interesa. U hrvatskom pravu se veći broj zakonskih i podzakonskih propisa odnosi na polaganje podmorske infrastrukture, međutim to ponekad nije najbolje rješenje. Cilj ovog rada je ponajprije raščlanjivanje međunarodne, a potom domaće legislative u svrhu što boljeg razumijevanja ove problematike. Analizom pravnog režima uspostavio se okvir i koraci koje subjekti moraju ispoštovati kako bi sklopili ugovor o koncesijama te položili podmorske kabele i cjevovode. Osim raščlanjivanja pravno regulatornih instrumenata, dani su i primjeri koji argumentiraju navedeni pravni okvir te institucije koje provode polaganje podmorskih infrastruktura ili imaju određenu ulogu u procesu polaganja.
Abstract (english)
The laying of submarine cable infrastructure and pipelines is a complex process where various entities such as public and private are intertwined. Therefore, proper legislature regulation is necessary due to the fact that area in question is maritime domain which is the right of every person. In Croatian law, there is a number of legislative framework refering to the laying of submarine infrastructure, but sometimes this is not the best solution. The aim of this paper is first of all to analyze the international and domestic legislation in order to better understand the importance of such submarine infrastructures. The analysis of the legal regime established the framework and necessary steps that entities must follow in order to conclude a concession agreement and lay submarine cables and pipelines. In addition to the analysis of legal regulatory instruments, examples were given to complement the stated legal framework and the institutions that carry out the laying of submarine infrastructures or have a certain role in the laying process.
