Abstract
Ovaj rad bavi se novim odredbama izmjena i dopuna Pomorskog zakonika iz 2019. godine koji regulira peljarenje. Pomorski zakonik definira pomorsko peljarenje kao vođenje plovnog objekta od stručnih osoba (peljara) i davanja stručnih savjeta zapovjedniku plovnog objekta, radi sigurne plovidbe u lukama, tjesnacima i drugim područjima unutrašnjih morskih voda i teritorijalnog mora Republike Hrvatske. Osim Pomorskog zakonika peljarenje je detaljno propisano i Pravilnikom o pomorskom peljarenju. Zbog krajnjeg cilja ostvarivanja sigurnosti plovidbe i zaštite broda, tereta i posade, kao i morskog okoliša, Pomorskim zakonikom su definirani uvjeti za obvezno peljarenje kao i izuzeća od obveznog peljarenja. Pravilnikom su propisani uvjeti koje moraju ispunjavati peljari, društva peljara i drugi čimbenici vezani uz ispravno i sigurno peljarenje.
Abstract (english)
The paper deals with the new provisions in the amendments to the Maritime Code from 2019, which regulates pilotage. Pilotage is the use of fixed visual references on the ground or sea by means of sight or radar to guide oneself to a destination, sometimes with the help of a map or nautical chart. Navigation at sea is ensured by numerous technical and administrative tasks, and it is also regulated by the Ordinance on maritime pilotage. Piloting refers to guiding ships and giving expert advice to the master of the ship, all with the aim of safe navigation. Due to the common goal of universal safety of navigation and protection of cargo and crew, ie people on board, the Maritime Code defines the conditions for compulsory pilotage and exemptions from compulsory pilotage. Also, this code prescribes the conditions that must be met by pilots, pilot companies and other factors related to proper and safe piloting.
