Abstract
U radu se obrađuje odgovornost pomorskog prijevoznika za izuzete ili iznimne slučajeve kao slojevit pravni institut čija je svrha olakšavanje prijevoznikove specifične i zahtjevne uloge. Sam institut čini skup iznimki od odgovornosti prijevoznika na temelju načela pretpostavljene krivnje te se u tim slučajevima njegova odgovornost prosuđuje po načelu dokazane krivnje. Prijevoznik da bi bio oslobođen od odgovornosti, dužan je dokazati postojanje jednog od izuzetih slučajeva i uzročnu vezu između... More tog slučaja i štete. Time se prebacuje teret dokaza o krivnji na nositelja prava. Institut izuzetih slučajeva reguliraju Haaška pravila i Rotterdamska pravila te naš Pomorski zakonik dok nije propisan Hamburškim pravilima. Less
Abstract (english)
In this paper is processing liability of the maritime carrier for exempt or exceptional circumstances as legal institution whose purpose is to facilitate the carrier’s specific and demanding roles. Institute consists of a set of exceptions from liability of the maritime carrier on the basis of the principles of presumed guilt and his responsibility under the principle of proven guilt in disputes for damages from contract of carriage of goods by sea. The carrier is obliged to prove existence of... More excepted peril and a causal link between that case and damage to be released from liability. With that, the burden of proof of guilt switches on the right holder. The Institute of excepted perils is regulated by Hague Rules and Rotterdam Rules, and with our Maritime Code until it was prescribed with Hamburg Rules. Less
