Abstract
U radu se definira pravni status pomorskog broda i drugih plovnih objekata te prikazuje postupak kroz koji brod mora proći kako bi njegov pravni status bio priznat. U Republici Hrvatskoj ta pitanja definirana su Pomorskim zakonikom. Kako bi brod mogao biti upisan u hrvatski upisnik brodova mora udovoljiti odreĎenim uvjetima te proći kroz postupak individualizacije tj. identifikacije. Postupak upisa broda u upisnik brodova u nadležnosti je lučke kapetanije. Nakon što je od strane Hrvatskog registra brodova napravljen tehnički nadzor te je utvrĎena sposobnost za plovidbu, brod mora voditi brodske isprave i knjige propisane Pomorskim zakonikom i ostalim pravilnicima.
Abstract (english)
In this paper the legal status of the vessel and other floating objects is to defined, and procedures a vessel must pass in order to be given legal status are specifed. In the Republic of Croatia, those questions are defined by the Maritime Code. In order for a vessel to be registered in the Croatian ship register it needs to satisfy certain conditions and pass the procedure of individualization i.e. identification. The procedures for registering a vessel into the ship register are under the jurisdiction of the Harbour master’s office. After the technical supervision is completed and the vessel is verified as seaworthy by the Croatian ship register, the vessel is ready for navigation. The vessel's certificate and books need to be updated as required by the Maritime Code and other by-laws.
