Abstract
Predmet ovog rada je analiza ugovora o slagačkom poslu. Ugovor o slagačkom poslu sklapaju lučki slagač i naručitelj. Tim ugovorom lučki slagač obvezuje se da će obaviti jednu ili više slagačkih operacija, a naručitelj slagačkog posla da će slagaču isplatiti nagradu. Lučki slagači su osobe koje se bave ukrcajem tereta na brod, iskrcajem tereta iz broda, slaganjem tereta na brod, te prekrcajem tereta s jednog prijevoznog sredstva na drugo. Na te se poslove prirodno nadovezuje slaganje tereta u kopnena prijevozna sredstva, skladištenje tereta u lučkim skladištima i sl. Ugovor o slagačkom poslu u Republici Hrvatskoj nije zakonski reguliran i spada u ugovore o djelu obveznog prava. Osnovni je pravni regulativ ugovor stranaka, a smatra se da je sklopljen kada se stranke sporazume o bitnim elementima. Slagački poslovi najvažniji su dio lučko-prijevoznih poslova.
Abstract (english)
The subject of this paper is to analyze the stevedoring contract. The stevedoring contracts are concluded between stevedores and clients. According to the contract, a stevedore is required to perform one or more stevedoring operations for which a client agrees to pay the award. Stevedores are people who manage operations of loading or unloading a ship, stowage of cargo and its transhipment from one mode of transport to another. These jobs are naturally supplemented by the arrangement of cargo in land transport vehicles, storage of cargo and so on. The stevedoring contract has not been legally regulated in the Republic of Croatia, and it falls within the scope of compulsory law. The basic legal remedy is an agreement of the parties, and it is considered to be concluded when the parties mutually agree on all essential elements. Stevedoring jobs are the most important part of the port transport operations.
