Abstract
Pomorskim osiguranjem ugovara se pravni posao kojim se osiguravaju brodovi, teret koji se prevozi brodovima, odgovornost brodara kao i drugi aspekti i rizici plovidbe morem. U ovom radu se definiraju isprave pomorskog osiguranja od kojih je najvažnija polica osiguranja. Osim pomorske police u pomorskom osiguranju se koriste druge isprave kao što je list pokrića, potvrda o sklopljenom osiguranju i certifikat osiguranja. Prijenos prava iz ugovora označava prijenos prava ugovornih stranaka na drugu osobu te se ostvaruje primjenom specifičnih odredaba prava osiguranja o prijenosu police osiguranja. Mogućnost prijenosa prava postoji samo za vrijeme trajanja osiguranja te na nju pravo imaju obje ugovorne stranke: osiguratelj i osiguranik.
Abstract (english)
Maritime insurance contracts a legal business that insures ships, cargo transported by ships, the liability of shipowners as well as other aspects and risks of navigation at sea. This paper defines the concept of maritime insurance the most important of which is insurance policy. Besides maritime policy there are other documents used in maritime insurance, such as cover sheet, certificate of completion for insurance and insurance certificate. Transfer of rights from the contract means transfer of rights from the contracting parties to other person and is realized by applying specific provisions of insurance law of insurance policy transferring. The possibility of transferring rights only exists for insurance duration and both parties have a right to it: insurer and insured.
