Abstract
Legalizacija prostitucije uvijek je aktualna tema oko koje ne postoji usuglašeno mišljenje upravo zbog činjenice kako legalizacija često ne rješava problem nasilja, prisilne prostitucije te crnog tržišta. Osim toga, sve su glasnije kritike kako je prostitucija oblik nasilja te odraz spolnih nejednakosti u društvu. Budući da je prostitucija kompleksna pojava sa mnogo različitih pojavnih oblika, ovdje su predstavljeni neki od njih, ali i primjeri različitih zakonskih ureĎenja. Nizozemska i Njemačka legalizirale su prostituciju pa ju samim time reguliraju, Švedska zabranjuje kupnju seksualnih usluga, dok hrvatski zakoni zabranjuju pružanje seksualnih usluga te svodništvo. Vidjet ćemo kako legalizacija često poboljšava radne uvjete te rješava pitanje socijalnog osiguranja, dok je švedski model uspio smanjiti broj seksualnih radnika/ica na ulicama. Unatoč tome, niti jedan od predstavljenih modela nije najbolji jer je svaki od njih doveo do različitih problema tijekom implementacije, ne uspijevajući pritom riješiti problem crnog tržišta.
Abstract (english)
Legalizing prostitution is a topic that still doesn't have a consensus opinions, mostly because of the fact that legalizing often doesn't solve the problems of violence, forced prostitution and black market. Besides, there are growing criticism that prostitution is a form of violence and a reflection of gender inequalities in society. Since prostitution is a complex phenomen with many different forms, some of them are shown here, as well as examples of different regulations. Netherlands and Germany legalized prostitution and thus regulate it, Sweden has banned the purchase of sexual services, while Croatian laws prohibit the provision of sexual services and pimping. We will see how legalization often improves working conditions and addresses the issue of social security, while the Swedish model has succeeded in reducing the number of sex workers on the streets. Nevertheless, none of the models presented is the best because each of them has led to different problems during implementation, failing to solve the black market problem.
