Abstract
Institut subrogacije osiguratelja, vrlo je važan institut prava osiguranja koji pridonosi ostvarenju pojedinih načela odštetnog osiguranja, a važnu ulogu ima i u sprječavanju štetnika da izbjegne svoju odgovornost za počinjenu štetu. Cilj ovog rada je analizirati razloge ustanovljenja ovog instituta te kako su pojedina pitanja koja se tiču pravne prirode, pravnog temelja, ograničenja i zastare subrogacije osiguratelja uređena domaćim pravnim izvorima. Također, ovim radom nastoje se naglasiti sličnosti i razlike između subrogacije osiguratelja i njoj srodnih instituta čije je poznavanje iznimno važno radi njihove primjene u praksi.
Abstract (english)
Insurers' right of subrogation is a very important institute in insurance law that contributes to the realization of the main principles of indemnity insurance. Also, it has an important role in preventing a person responsible for damage from avoiding its responsibility for caused damage. The main goals of this thesis were to analyze reasons for establishing insurers' right of subrogation, whats is its original title, what are restrictions of subrogation, and the statute of limitations in Croatian law. Also, the subject of this paper is to emphasize similarities and differences between insurers' right of subrogation, recourse, and cession which is very important for their practical use.
