The Constitution of the Republic of Croatia, in Article 3, declares the inviolability of property as one of the greatest values of the constitutional order of the Republic of Croatia, and in Article 48, Paragraph 1, it guarantees the right to property, as one of the human rights and fundamental freedoms. The protection of the constitutional guarantee of property rights is equal to that provided for constitutional rights and freedoms. However, the constitutional guarantee of property rights is not absolute. The content of property rights should be viewed as a whole through the provisions of the Constitution that guarantee it and those provisions that regulate its limitation. In order for the restriction to be constitutionally acceptable, it must be legal, in the interest of the Republic of Croatia and adequately compensated. Any constitutionally permitted interference with the right to property must ensure a fair balance between the interest in respecting and protecting the constitutional guarantee of the property rights of private persons and the demands posed by general interests.
