A model procedure to resolve an issue important for the uniform application of law is a procedure that is initiated when there is a large number of disputes that have already been initiated or are expected to be initiated in a shorter period, and in which the decision depends on the resolution of the same legal issue that is important for ensuring the uniform application of law and the equality of all in its application or for the development of law through judicial practice. The model procedure is a special type of procedure that is conducted at the Supreme Court of the Republic of Croatia. It consists of two stages: the proposal for the permission of the procedure and the decision in the same. The proposal for the permission is decided by a panel of five judges, and in the model procedure, a panel of thirteen judges of the Supreme Court of the Republic of Croatia decides. In the proceedings, a verdict is issued by which the Supreme Court takes a legal position on an important legal issue. So far, four proposals for the permission of model procedure have been submitted, two have been accepted, two have been rejected. The legal interpretation of the Supreme Court regarding the model procedure has a binding effect. There is an unevenness in practice due to the first conducted model procedure. The 2022 Amendment to the Civil Procedure Act introduces changes and novelties to the model procedure. The changes relate to the number of judges in the panel, the submission of proposals for permission, the communication of the Supreme Court of Justice with the courts and more.
