Abstract Međunarodna organizacija rada (MOR) je jedina tripartitna organizacija UN-a, osnovana 1919. godine. Spaja vlade, poslodavce i radnike država članica da zajedno postavljaju standarde rada, razvijaju politike i programe koji promiču dostojanstven rad za sve žene i muškarce. MOR djeluje kroz tri glavna tijela: Međunarodna skupština, Upravno vijeće i Međunarodni ured rada. Akti koje donosi MOR su konvencije i preporuke. Konvencije obvezuju sve države članice koje ih ratificiraju, dok su preporuke neobvezujuće i služe više kao smjernice ili kao dopuna konvencijama. U svijetu je diskriminacija još uvijek veliki problem i posebno je vidljiva na radnom mjestu. MOR je donio četiri konvencije iz tog područja – Konvencija br. 100 o jednakosti plaća radnika i radnica za rad jednake vrijednosti (1951.), Konvencija br. 111 o diskriminaciji u zaposlenju i zanimanju (1958.), Konvencija br. 156 o radnicima s obiteljskim obvezama (1958.) te Konvencija br. 190 o nasilju i uznemiravanju (2019.). Republika Hrvatska je ratificirala sve osim posljednje konvencije, ali je podnijela izvještaj o primjeni Hrvatskom Saboru. Implementacija ovih konvencija u hrvatsko zakonodavstvo vidljiva je u Zakonu o radu, Zakonu o suzbijanju diskriminacije, Zakonu o ravnopravnosti spolova te u samom Ustavu RH. S vremenom se standardi rada i života razvijaju i postaju sve bolji, stoga je neke od konvencija potrebno prilagoditi suvremenom životu. Tako i Konvencija br. 45 o zapošljavanju žena na poslovima koji se obavljaju pod zemljom u rudnicima svih vrsta nije u skladu s pravom EU. Tripartitna radna skupina za mehanizam revizije standarda je na sjednici 2018. godine predložila poticanje država članica na ratifikaciju suvremenije Konvencije br. 176 – o sigurnosti i zdravlju u rudnicima, koja je u skladu s današnjim standardima. Hrvatska još uvijek nije službeno otkazala ovu Konvenciju, ali se tekst sličan odredbama Konvencije ne može pronaći u hrvatskom zakonodavstvu. Iz svega navedenog može se zaključiti da su akti MOR-a pozitivno utjecali na razvoj hrvatskog zakonodavsta, te da, iako uvijek ima mjesta za razvoj i napredak, konvencijama MOR-a su se osigurali radni standardi koji štite od diskriminacije i potiču na promicanje jednakosti svih ljudi u području rada.
Abstract (english) The International Labor Organization (ILO) is the only tripartite organization of the UN, founded in 1919. It brings together governments, employers and workers of member countries to jointly establish labor standards, develop policies and programs to promote decent work for all women and men. The ILO operates through three main bodies: the International Labour Conference, the Governing Body and the International Labour Office. Acts adopted by the ILO are Conventions and Recommendations. Conventions are binding on all member states that ratify them, while recommendations are non-binding and serve more as guidelines or as supplements to conventions. Discrimination continues to be a major problem in the world and it is particularly visible in the workplace. The ILO has adopted four Conventions in this area - Convention no. 100 on equal remuneration for male and female workers for work of equal value (1951), Convention no. 111 on discrimination in employment and occupation (1958), Convention no. 156 on workers with family responsibilities (1958) and Convention no. 190 on violence and harassment (2019). The Republic of Croatia has ratified all except the last convention, but has submitted a report on implementation to the Croatian Parliament. The implementation of these Conventions in Croatian legislation can be found in the Labor Act, the Anti-Discrimination Act, the Gender Equality Act and the Constitution of the Republic of Croatia itself. With time, working and living standards develop and improve, so that some Conventions have to be adapted to modern life. For example, Convention no. 45 on the employment of women in jobs performed underground in mines of all types is not in accordance with EU law. At the 2018 session, the tripartite working group for the standards review mechanism proposed encouraging member states to ratify the more modern Convention no. 176 - on safety and health in mines, which is in accordance with today's standards. Croatia has not officially denounced this Convention, but a text similar to the provisions of the Convention cannot be found in Croatian legislation. From all of the above, it can be concluded that the acts of the ILO have had a positive impact on the development of Croatian legislation, and that, although there is always room for development and progress, ILO Conventions have ensured working standards that protect against discrimination and encourage the promotion of equality for all people in the field of work.
