Abstract | Potrošnja javnih sredstava za nabavu dobara, radova i usluga utječe izravno na proračun te na gospodarstvo u cjelini, stoga ono mora biti uređeno, odnosno podvrgnuto kompleksnim i detaljno propisanim postupcima. Postupak jednostavne (bagatelne) nabave provodi se kada je predmet nabave robe, usluga, radova ili provedba projektnih natječaja procijenjen na najnižu vrijednost u domaćem javnonabavnom poretku i za takvu nabavu vrijede najliberalnija pravila. Pravila, uvjeti i postupci jednostavne nabave propisuju se općim podzakonskim općenormativnim aktom, na temelju važećeg Zakona o javnoj nabavi te se isti primjenjuje poštujući načela javne nabave u Republici Hrvatskoj. U rujnu 2022. godine, Ministarstvo gospodarstva i održivog razvoja donijelo je Smjernice kojima je cilj uputiti naručitelje kako izraditi opći akt za provedbu postupaka jednostavne nabave odnosno objasniti na što naručitelji moraju obratiti pozornost prilikom donošenja svojih općih akata kako bi ostali u okviru načela javne nabave koja se primjenjuju na sve nabave. U ovom radu prikazujem opći pregled postupka jednostavne nabave na primjeru Pravilnika o provedbi postupka jednostavne nabave, koji je donio dječji vrtić. Također, dajem osvrt na važnost i redoslijed koraka u procesu provedbe bagatelne nabave u dječjem vrtiću, kao naručitelju robe, radova i usluga, sukladno propisanim pragovima. Nakon provedenog postupka jednostavne nabave, naručitelj je dužan pridržavati se daljnjih zakonskih odredbi koje su nužne radi ostvarenja načela transparentnosti i prava na pristup informacijama. Nadalje, iznosim kratki osvrt na recentnu presudu Visokog upravnog suda u Zagrebu, u kojoj je sud odbio žalbu tužitelja i obrazloženju riješio da odluke o odabiru u postupcima jednostavne nabave nisu normativno određene kao upravni akti, kao i činjenica da postupak jednostavne nabave nije postupak kojim se rješava upravna stvar. Posljednje, dajem mišljenje o mogućnostima pravne zaštite ponuditeljima u okviru Zakona o općem upravnom postupku i Zakona o upravnim sporovima s obzirom da ista nije predviđena važećim pravilnicima o jednostavnoj nabavi. |
Abstract (english) | The consumption of public funds for the procurement of goods, works and services directly affects the budget and the economy as a whole, therefore it must be regulated, i.e. subjected to complex and detailed procedures. The procedure of simple (trivial) procurement is carried out when the subject of the procurement of goods, services, works or the implementation of project tenders is estimated at the lowest value in the domestic public procurement order and the most liberal rules apply to such procurement. The rules, conditions and procedures of simple procurement are prescribed by a general sub-legal general normative act, on the basis of the valid Public Procurement Act, and it is applied respecting the principles of public procurement in the Republic of Croatia. In September 2022, the Ministry of the Economy and Sustainable Development issued Guidelines whose aim is to guide contracting authorities on how to draft a general act for the implementation of simple procurement procedures, i.e. to explain what contracting authorities must pay attention to when adopting their general acts in order to remain within the framework of public procurement principles that are applied to all purchases. In this paper, I present a general overview of the simple procurement procedure using the example of the Ordinance on the implementation of the simple procurement procedure, which was adopted by the kindergarten. I also give an overview of the importance and order of steps in the process of implementing trivial procurement in a kindergarten, as an orderer of goods, works and services, in accordance with the prescribed thresholds. After the simple procurement procedure has been carried out, the client is obliged to comply with further legal provisions that are necessary for the realization of the principles of transparency and the right to access to information. Furthermore, I present a brief review of the recent judgment of the High Administrative Court in Zagreb, in which the court rejected the plaintiff's appeal and explained that decisions in simple procurement procedures are not normatively determined as administrative acts, as well as the fact that the simple procurement procedure is not a procedure that resolves an administrative matter. Lastly, I give my opinion on the possibilities of legal protection for bidders under the Law on General Administrative Procedure and the Law on Administrative disputes, considering the fact that legal protection is not implemented in the Ordinance. |
