The institute of deprivation of business (legal) capacity in Croatian law has been applied since the ratification of the Convention on the Rights of Persons with Disabilities. This master thesis describes in detail the process of depriving business capacity, citing examples from the practice of the ECtHR, the expert examination process, the rights and obligations of guardians, and the jurisdiction of the Croatian Institute for Social Work. Due to the dubious interpretation of Article 12 of the Convention and the legislator's attempt to harmonize the provisions on deprivation of legal capacity with the Constitution of the Republic of Croatia, the Family Law from 2015 to today contains an article that a person cannot be deprived of legal capacity completely, but only partially. In view of the above, the Constitutional Court of the Republic of Croatia in April 2023 issued a decision and ruling, which revokes the provision in question in the Family Law, which expires on December 31, 2023. It remains to be seen whether the complete deprivation of legal capacity, which is presented as institute that is applied as an exception, turn it into a rule in practice and suppress the partial deprivation of legal capacity.
