The fundamental right of parents is the right to care for their children, and the right of every child is the right to both parents. In case of parental divorce, the currently valid Family Law prescribes the way in which parents will exercise parental care, which is going to be in the best interest of the child. Parental care consists of the responsibilities, rights and duties of the parents, the purpuse of which is to protect and promote the child¬'s personal and property rights and well-being, which is prescribed by the Family Law. It is the parents' duty to communicate with the child about the contents of parental care, in accordance with his age and maturity. The goal of parental care is the protection of the child's subjective rights, which are guaranteed to the child by the norms of international and national legal acts. Regardless of the way parental care is exercised, parents have the right to make decisions related to the exercise and protection of the child's subjective rights, while the child live with one parent and has personal relationships with other, which must be mutually respected. The aim of this final paper is to investigate and explain the meaning and role of parental care.
