The Court of Arbitration for Sport (CAS) is an international arbitration court responsible for administering sports-related disputes through arbitration or mediation. It represents the pinnacle of the world system in resolving sports-related disputes, whether in terms of national or international sports matters. Although it was established as an internal body of the International Olympic Committee, it is independent of any sports organization. CAS is a valid arbitral tribunal, as confirmed by the decisions of the Swiss Supreme Federal Court. CAS operates on the basis of its own legal regulations adapted to the specific needs of sport, creating in an indirect way the Lex sportiva in international sports relations. The most important and basic legal source for the operation of the court is the CAS Code. The CAS comprises of divisions which are responsible for administering certain types of disputes, to a certain extent and according to precisely defined rules applicable to the type of procedure that certain division carry out. These are: The Ordinary Arbitration Division, The Appeals Arbitration Division, and The Anti-Doping Division. Beside to these three main divisions, ad hoc divisions are also established. The only legal remedy allowed to challenge a CAS arbitral award in Switzerland is an action to set aside. It can only and exclusively be submitted to the Swiss Federal Supreme Court. The fundamental provisions, referring to the jurisdiction of this court in challenging international arbitral awards made in Switzerland, are contained in the Swiss Private International Law Act. In other countries, it is necessary to carry out the procedure for the recognition and enforcement of foreign arbitral awards, in which case the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards from 1958 is applied.
