Abstract
U radu se obrađuje tema mane volje u rimskom pravu, s naglaskom na zabludi kao najspornijoj mani volje u rimskom, ali i hrvatskom ugovornom pravu. Uspoređuju se mane volje kojima razvoj potječe iz rimskog prava s razvojem i reguliranjem mana volje u hrvatskim zakonima, konkretno Zakon o obveznim odnosima iz 1978. godine i Zakon o obveznim odnosima iz 2005. godine kao dva zakona koja su doprinijela razvoju obveznog prava u Republici Hrvatskoj, ali u dva različita pravna sustava, socijalističkom i kapitalističkom. Rad se ukratko osvrće na pravne posljedice mana volje, a osobito se naglašava njihova razlika.
Abstract (english)
The topic of this thesis is lack of will in Roman private law with the emphasis on error as the most disputable type of lack of will both in Roman and Croatian contract law. Further on there is a comparison between the types of lack of will in Roman private law and their development and regulation in Croatian contract law, specifically Civil Obligations Act 1978 and Civil Obligations Act 2005 as the two main Acts that contributed to the development of obligations law in Republic of Croatia. The thesis gives a brief sight into the legal consequences of lack of will with the emphasis on their differences.
