Abstract
This paper discusses three critical issues: the CJEU’s inconsistent use of autonomous concepts of EU law, the standing of ‘pastiche’ as an exception in EU copyright law, and the inherent issues with the current EU copyright framework. Firstly, the paper notes that the CJEU often declares concepts as autonomous simply due to the lack of explicit reference to national laws in EU legislation. This can result in almost every undefined term being considered autonomous, even when unintended by the EU legislator. The paper concludes that the CJEU should strictly follow its Ekro formula, which considers legislative context, wording, and objectives, before declaring concepts as autonomous. However, due to the limited case law examined, further academic exploration is recommended. Secondly, applying the Ekro formula to ‘pastiche,’ the paper argues it should not be an autonomous EU concept because it has minimal economic impact, primarily conveying messages rather than generating revenue. As such, differing national regulations on ‘pastiche’ have little negative impact on the internal market, suggesting that fostering diverse local cultures should take precedence over EU-wide regulation. Thirdly, the paper critiques the current EU copyright framework, proposing three solutions. If the goal is a complete internal market, a unified EU copyright code is necessary. Alternatively, copyright should allow for flexibility to promote art and creativity. Lastly, the paper acknowledges a potential compromise to this matter: defining only the essential characteristics of a concept at the EU level, leaving specific features to Member States. Therefore, it proposes an autonomous definition of 'pastiche' as ‘a use that incorporates recognisable elements from pre-existing works in a distinct manner.’

Ovaj se rad rad bavi trima ključnim pitanjima: nedosljednom uporabom autonomnih koncepata prava EU od strane Suda Europske unije (dalje: EU), status 'pastiša' kao iznimke u okviru autorskog prava EU i inherentni problemi trenutnog uređenja autorskog prava EU. Prvo, rad primjećuje da Sud EU često proglašava koncepte autonomnima samo zbog nedostatka izričitog upućivanja na nacionalne zakone u zakonodavstvu EU. To može rezultirati time da se gotovo svaki neodređeni pojam smatra autonomnim, čak i kada to nije bila namjera zakonodavca EU. Stoga, rad zaključuje da bi Sud EU trebao strogo slijediti svoju Ekro formulu, koja uzima u obzir zakonodavni kontekst i ciljeve, prije nego što proglasi pojmove autonomnima. Međutim, zbog ograničenog broja analiziranih slučajeva, preporučuje se daljnje akademsko istraživanje ovog pitanja kako bi se donijeli precizniji zaključci. Drugo, primjenjujući Ekro formulu na 'pastiš', rad tvrdi da on ne bi trebao biti autonomni pojam prava EU jer ima minimalan ekonomski utjecaj, prvenstveno služeći za prenošenje poruke i mišljenja, umjesto stvaranja prihoda. Iz toga proizlazi da različiti nacionalni propisi o 'pastišu' imaju zanemariv utjecaj na unutarnje tržište, sugerirajući da bi razvitak i poticanje kulturološke raznolikosti trebali imati prednost nad njegovom unificiranom regulacijom na razini EU. Treće, rad kritizira trenutni okvir autorskog prava EU, predlažući tri rješenja. Ako je cilj uspostava cjelovitog unutarnjeg tržišta, nužan je jedinstveni kodeks autorskog prava EU. S druge strane, autorsko pravo treba omogućiti fleksibilnost za poticanje umjetnosti i kreativnosti zbog čega unificiranje nije idealno rješenje. Konačno, rad se poziva na potencijalno kompromisno rješenje: definirati samo bitne karakteristike pojma na razini EU, dok bi specifične značajke ostale u nadležnosti država članica. Stoga se predlaže definicija 'pastiša' koja glasi: 'korištenje u koje su uključeni prepoznatljivi elementi iz prethodno postojećih djela na drugačiji način.'
