This paper presents the institute of arbitrability, focusing on Croatian and comparative law. The paper begins with an introduction to the subject of arbitration in general, after which the arbitration agreement itself, to which the institute of arbitrability is bound, is analyzed in more detail. Afterwards the definition of the concept of arbitrability itself is covered, and it is then elaborated in more detail through its subtypes; objective, subjective and jurisdictional. The concept of objective arbitrability is defined, and the different regulation of this institute in Croatia and in comparative legal legislation is compared, followed by an explanation of why objective arbitrability is limited in the first place. Subjective arbitrability tells us who can be a party in arbitration proceedings, and jurisdictional arbitrability determines when there is exclusive jurisdiction of a court that limits arbitration. The arbitrability of labor law disputes in Croatia is analyzed in more detail, focusing on the Croatian Law of Labor and general arbitration rules, and in America, where the judgments of the US Supreme Court related to disputes on collective agreements are processed. It also deals with the arbitrability of disputes arising within companies, both in Croatian and German law. In conclusion, the topic is rounded off by showing the relationship between arbitrability and state courts, and the position of the institute of arbitrability in the legal system itself.
