Abstract
Dispute Avoidance and Adjudication Board (DAAB) je neovisno tijelo, sastavljeno od jednog ili tri člana, kojemu je u okviru FIDIC ugovora povjerena ključna uloga sprječavanja i rješavanja sporova u međunarodnim građevinskim projektima. Ovaj rad analizira razvoj DAAB-a iz prethodnog mehanizma, Dispute Adjudication Board-a (DAB), naglašavajući njegovu tranziciju prema proaktivnom pristupu u prevenciji sporova. Detaljno se istražuju pravila i procedure za imenovanje članova DAAB-a, njihove ključne obveze i prava, te ovlasti koje im omogućuju učinkovito izvršavanje njihove funkcije. Poseban naglasak stavljen je na razlike u primjeni DAAB-a kroz različite FIDIC knjige, te na glavne izazove i prepreke s kojima se DAAB suočava u praksi. Zaključno, rad razmatra kako ispravno postavljanje i djelovanje DAAB-a može značajno doprinijeti uspjehu građevinskih projekata.
Abstract (english)
The Dispute Avoidance and Adjudication Board (DAAB) is an independent body, composed of one or three members, entrusted within the framework of FIDIC contracts with the crucial role of preventing and resolving disputes in international construction projects. This paper analyzes the development of the DAAB from the previous mechanism, the Dispute Adjudication Board (DAB), highlighting its transition towards a proactive approach in dispute prevention. The rules and procedures for the appointment of DAAB members, their key duties and rights, as well as the powers enabling them to effectively perform their functions, are thoroughly examined. Special emphasis is placed on the differences in the application of the DAAB across various FIDIC books, and on the main challenges and obstacles the DAAB encounters in practice. Finally, the paper considers how the proper establishment and functioning of the DAAB can significantly contribute to the success of construction projects.
