Abstract
Ovaj rad bavi se pitanjem opravdanih ograničenja jedne od najvažnijih sloboda koje promovira Europska unija, slobodom kretanja. Glavni fokus ovoga rada stavljen je na slobodu kretanja radnika, odnosno na situacije kada Sud Europske unije ima mogućnost ograničiti slobodno kretanje kako bi zaštitio određeni viši interes, odnosno sigurnost pojedine države članice. Pored opravdanih ograničenja, jedan dio rada promatra aspekt ograničinjenja s kojima se radnici susreću u stvarnosti a koji se ne smatraju opravdanima. Osim toga, rad daje uvid u položaj Hrvatske, koja kao relativno mlada članica Europske unije, tek treba iskoristiti puni potencijal slobode kretanja radnika.
Abstract (english)
This paper deals with the issue of justified restrictions on one of the most important freedoms promoted by the European union, freedom of movement. The main focus of this paper is placed on the free movement of workers, especially on situations when Court of Justice of the European union has the possibility to restrict free movement in order to protect higher interest, especially the security of an individual memeber state. In addition to justified restrictions, one part of the paper deals with the aspect of restrictions that workers encounter in reality that are not considered justified. In addition, the paper provides an insight into the position of Croatia, which, as a relatively young memeber of European union , has yet to exploit the full potential of freedom of movement for workers.
