Abstract U ovom se radu analizira na koji način kazneno zakonodavstvo pruža zaštitu osobama s invaliditetom obzirom da je u suvremenom društvu nasilje nad osobama s invaliditetom česta pojava. U početku se rada obrađuje pojam osobe s invaliditetom u hrvatskom pravnom sustavu kroz odredbe Ustava Republike Hrvatske, određenih međunarodnih ugovora i zakona jer ne postoji općeprihvaćena definicija tog pojma. Najprihvatljiviju definiciju osoba s invaliditetom pruža Konvencija o pravima osoba s invaliditetom koja predstavlja prvi pravno obvezujući međunarodni dokument koji određuje i štiti prava osoba s invaliditetom. U hrvatskom se društvu uspostavio i institut pravobranitelja koji, prema članku 2. Zakona o pravobranitelju za osobe s invaliditetom, „štiti, prati i promiče prava i interese osoba s invaliditetom“. U nastavku se rada navode oblici nasilja nad osobama s invaliditetom, posljedice takvog nasilja te razlozi zbog kojih ono ostaje neprijavljeno. Osobe s invaliditetom spadaju u ranjivu skupinu društva zbog čega su češće izložene nasilju, a unatoč postojanju većeg broja zakona kojima se regulira nasilje, nisu dovoljno zaštićene. Dalje se u radu analizira na koji način Kazneni zakon štiti osobe s invaliditetom kroz odredbe instituta neubrojivosti, pojedinih kaznenih djela (najčešće kao kvalificirani oblik nekog kaznenog djela) te se analizira koncept ranjive osobe koju uvodi KZ/11. U posljednjem se dijelu detaljno analizira presuda Europskog suda za ljudska prava u predmetu Đorđević protiv Hrvatske gdje je utvrđena povreda prava zajamčenih Konvencijom za zaštitu ljudskih prava i temeljnih sloboda u odnosu na podnositelje zahtjeva te im je dosuđena pravična naknada. U tom se predmetu ogleda problematika pristupa maloljetnim počiniteljima kaznenog djela koji zbog svoje dobi nisu kazneno odgovorni te izostanak odgovora nadležnih tijela vlasti na višegodišnje maltretiranje i zlostavljanje osobe s invaliditetom od strane skupine djece.
Abstract (english) This paper analyzes the way in which criminal law offers protection to people with disabilities, considering the fact that violence against people with disabilities is a common occurrence in today's society. The beginning of this paper analyzes the term „person with disability“ in Croatia's legal system through regulations of the Constitution of the Republic of Croatia, certain international contracts and laws, because a universally accepted definition of the term doesn't exist. Convention on the Rights of people with disabilities offers the most acceptable definition of a person with disability and it represents the first legaly binding international document which defines and protects the rights of people with disabilities. The institute of Ombudsman, which, according to the 2. article of Zakona o pravobranitelju za osobe s invaliditetom „protects, follows and promotes rights and interests of people with disabilities“ was established in Croatian society. The next part of this paper lists the forms of violence against people with disabilities, the consequences of such violence and the reasons why this type of violence is rarely reported. People with disabilities are a vulnerable social group which is why they are more frequently subjects of violence, and despite there being a large number of laws which regulate violence, they are not protected enough. In continuation, the way in which criminal law protects people with disabilities through regulations of individual offenses (often as a qualified form of some criminal offense) and the concept of a vulnerable individual which is introduced by KZ/11 are analyzed. The last part of this paper analyzes, in detail, the verdict of European court of Human Rights in the Đorđević versus Croatia case, where the violation of rights guaranteed by the European Convention on Human Rights in regards to the applicants is established and a fair compensation is awarded to them. This case demonstrates the difficulty of approaching underage perpetrators of criminal offenses who are not criminally liable because of their age, and the authorities' absence of response to the perennial maltreatment and molestation of people with disabilities by a group of children.
