Abstract
Ovaj diplomski rad bavi se temom dogovorenih brakova u europskom međunarodnom privatnom pravu. Dogovoreni brakovi nisu novost, štoviše, stoljećima su se prakticirali zbog različitih interesa, kao što je primjerice jačanje dinastija, širenje carstva, zbrinjavanje ženske populacije djece, vjerski razlozi i drugo. U današnje se vrijeme on prakticira s ciljem stjecanja neke koristi. S jedne strane to je dobivanje državljanstva, osiguravanje radnih dozvola, prava boravka i nastanjivanja kada su u pitanju prava građanina EU, dok s druge strane radi postizanja određene materijalne koristi. Reguliranje dogovorenog braka nalazi se u zakonodavstvima brojnih europskih i svjetskih zemalja. Ovaj rad prati pozitivno pravne propise međunarodnog privatnog prava i europskog prava s osvrtom na hrvatsko zakonodavstvo. Također obrađuje relevantne presude Europskog suda za ljudska prava.
Abstract (english)
This final paper deals with the topic of marriage of convenience in European private international law. Marriages of convenience are not a novelty, moreover, they have been practiced for centuries due to different interests, such as strengthening dynasties, expanding empires, taking care of the female population of children, religious reasons and other. Nowadays, it is practiced with the aim of gaining some benefit. On the one hand, it is obtaining citizenship, securing work permits, residence rights when it comes to EU citizens rights, while on the other hand, it is to achieve certain material benefits. Many countries of Europe and worldwide provide legal framework for marriage of convenience. This final paper deals with marriage of convenience issues in the context of private international law and European law rules, with specific reference to Croatian legislation. It also refers to relevant judgments of the European Court of Human Rights.
