Abstract | Policijski službenik kao djelatnik Ministarstva unutarnjih poslova, a i ostali državni službenici u državnim tijelima, dužni su izvršavati poslove koji su im propisani Zakonom. Ukoliko se isti ne pridržavaju Zakona te drugih propisa za vrijeme obavljanja službe snosit će disciplinsku odgovornost za povredu službene dužnosti, dok će policijski službenici snositi odgovornost za povredu počinjenu i izvan službe. Povrede službene dužnosti temeljem Zakona o policiji i Zakona o državnim službenicima se dijele na lakše i teže povrede službene dužnosti čije sa odgovornost utvrđuje kroz prikupljanje dokaza o počinjenoj povredi pa do odlučivanja o počinjenoj povredi. U postupku o lakoj povredi službene dužnosti koju je počinio državni službenik odlučuje čelnik tijela dok u postupku za policijskog službenika tu odluku donosi Ministar ili nadređeni rukovoditelj. Kod počinjenja teške povrede službene dužnosti čelnik tijela je dužan dostaviti zahtjev za pokretanje disciplinskog postupka čiju će odluku donijeti u prvom stupnju disciplinski sud i u drugom stupnju viši disciplinski sud za policijske službenike. Kod zahtjeva za pokretanje postupka radi teške povrede službene dužnosti koju je počinio državni službenik u prvom stupnju odlučuje Službenički sud, a u drugom stupnju Viši službenički sud. Protiv odluke donesene u prvom stupnju moguće je uložiti žalbu, a dok protiv odluke u drugom stupnju nije moguće uložiti žalbu nego je potrebno pokrenuti upravni spor. Kao i za bilo koju drugu povredu propisa, tako i kod povrede službene dužnosti, je moguće izreći određene kazne od kojih je opomena najblaža, a prestanak državne službe najteža kazna. Još jedna izrazito bitna pravna sankcija što se tiče počinjene povrede službene dužnosti i zaštite interesa i ugleda državnog tijela je udaljenje iz službe koja se određuje službeniku protiv kojeg je pokrenut kazneni postupak, postupak zbog teže povrede službene dužnosti sa obilježjima korupcije ili je podnesena kaznena prijava radi počinjenja kaznenog djela nasilje u obitelji, a isto tako ako je počinjena povreda takve prirode da bi ostanak službenika štetio ugledu službe. |
Abstract (english) | A police officer as an employee of the Ministry of the Interior, as well as other civil servants in state bodies, are obliged to perform the tasks prescribed by law. If they do not comply with the Law and other regulations during the service, they will bear disciplinary responsibility for the violation of official duty, while police officers will bear responsibility for the violation committed outside the service as well. Violations of official duty pursuant to the Law on Police and the Law on Civil Servants are divided into minor and serious violations of official duty, the responsibility of which is determined by collecting evidence of the violation until the decision on the violation is made. In the procedure for a minor violation of official duty committed by a civil servant, the head of the body decides, while in the procedure for a police officer this decision is made by the Minister or the superior. When committing a serious violation of official duty, the head of the body is obliged to submit a request for initiating disciplinary proceedings, the decision of which will be made in the first degree by the disciplinary court and in the second degree by the higher disciplinary court for police officers. In the case of a request to initiate proceedings for a serious violation of official duty committed by a civil servant, the Civil Service Tribunal shall decide in the first degree, and the Senior Civil Service Tribunal in the second degree. It is possible to appeal against the decision made in the first degree, and it is not possible to appeal against the decision in the second degree, but it is necessary to initiate an administrative dispute. As with any other violation of regulations, so with the violation of official duty, it is possible to impose certain penalties, of which the reprimand is the mildest, and the termination of civil service the most severe punishment. Another extremely important legal sanction regarding the violation of official duty and protection of the interests and reputation of a state body is removal from the service assigned to the official against whom criminal proceedings have been instituted, proceedings for serious violation of official duty with corruption or criminal charges committing the criminal offense of domestic violence, and also if a violation of such a nature has been committed that the remaining officer would damage the reputation of the service. |
