Abstract Javna nabava je zanimljiv, složen, stručan i opsežan postupak, koji obuhvaća dobru pripremu, tj. istraživanje tržišta te dobro znanje Zakona o javnoj nabavi. Tema ovog završnog rada je nabava građevinskih radova u otvorenom postupku javne nabave te FIDIC ugovori. Otvoreni postupak javne nabave je najčešće korišteni postupak, te shodno tome financijski najzastupljeniji. Nabava građevinskih radova obuhvaća građevinske radove izgradnje objekata, radove na adaptacijama objekata, radove na postavljanju instalacija, radove na temeljima za postavu modularnih objekata i slično. U radu je obrađen postupak javne nabave radova na adaptaciji stare zgrade društvene namjene koju će nakon uređenja koristiti udruge. Na početku rada obrađuje se teorijski dio Zakona o javnoj nabavi („Narodne novine“, br. 120/16). Postupak nabave je započeo istraživanjem tržišta i prethodnim savjetovanjem sa zainteresiranim gospodarskim subjektima. Nakon toga je slijedila objava poziva na nadmetanje i dokumentacije o nabavi u Elektroničkom oglasniku javne nabave. Protekom roka za dostavu ponuda povjerenstvo je obavilo otvaranje ponuda te pregled i ocjenu istih. Nakon pregleda i ocjene ponuda naručitelj je donio odluku o odabiru najpovoljnijeg ponuditelja te sklopio ugovor. Međutim, odabrani ponuditelj nije poštovao ugovorne odredbe te je naručitelj morao raskinuti ugovor i krenuti u postupak ponovnog rangiranja. Postupak je uspješno završen odabirom novog ponuditelja te sklapanjem novog ugovora o nabavi radova. Kako je 2021. godina bila izazovna, pojavila se i situacija sa brojnim poskupljenjima. Prvi val poskupljenja krenuo je na proljeće i to poskupljenjem građevinskog materijala, a naročito željeza. Zbog valova poskupljenja, ponuditelj je kod kupnje materijala platio veću cijenu, na što on ni naručitelj nisu mogli utjecati te se morao sklopiti dodatak ugovoru kako bi se izvođenje radova moglo završiti da ni jedna strana ne bi bila oštećena.
Abstract (english) Public procurement is an interesting, complex, specialized and extensive procedure that encompasses a certain degree of preparation i.e. market research as well as a good knowledge of Public Procurement Law. This paper's topic is construction procurement in an open public procurement procedure as well as FIDIC contracts. An open public procurement procedure is the most common procedure therefore financially most common as well. Procurement in construction includes building and construction works on a facility, reconstruction work, installation work, foundation work with modular facilities etc.
This paper covers an example of a public construction procurement procedure regarding a reconstruction of a public building intended for local associations and their activities.The beginning of this paper deals with the theoretical part of the Public Procurement Law (Official Gazette, no.120/16). The procurement procedure started with market research and prior consultation with interested economic operators. This was followed by the publication of the contract notice and the documentation on procurement in Electronic Public Procurement Advertisement channel. After the expiry of the deadline for submission of tenders, the tenders were opened, revised and evaluated by the Tender Committee. Afterwards, the contracting party opted for and awarded the contract to the most economically advantageous tenderer. However, the chosen tenderer failed to comply with the contract provisions forcing the contracting party to terminate the contract and initiate a tender re-ranking procedure. The procedure was successfully completed and a new tenderer was selected and awarded a contract. Furthermore, 2021 has so far been riddled with many challenges, including various price increases. The first building materials' price hike occurred in spring, especially the price of iron. Consequently, due to the price hikes, the tenderer paid more for the building material which was out of both the tenderer's and the client's control. To avoid any injuries to both Parties during the completion of construction, an Annex was added to the contract.
