Abstract
U ovom radu bit će prikazana važnost Deklaracije o pravima čovjeka i građanina , Europske konvencije o ljudskim pravima i temeljnim slobodama te Europskog sudu za ljudska prava kroz slučaj Narodni list d.d. protiv Hrvatske. Rad se temelji upravo na slučaju Narodnog lista d.d. protiv Hrvatske koji je svoj pravni završetak dobio na Europskom sudu za ljudska prava. Slučaj se sastoji od dva događaja koji su proizišli jedan iz drugog, a povezuju ih sudska praksa i mediji. Okosnica mu je kršenje prava na slobodu mišljenja i izražavanja koji su zajamčeni Konvencijom, Ustavom i domaćim zakonodavstvom. Sukob postoji između prava na privatnost suca i slobode medija.
Abstract (english)
This paper will present the importance of the Declaration of the Rights of Man and of the Citizen, the European Convention on Human Rights and Fundamental Freedoms and the European Court of Human Rights through the case of Narodni list d.d. against Croatia. The basis of this paper is the case of Narodni list d.d. against Croatia which has received its legal conclusion at the European Court. The case consists two events that were derived one from the other and the connection between two of them are the court practice and the media. The basis of this case is a violation of the right to freedom of opinion and expression which are guaranteed by the Convention, the Constitution and domestic law. There is a conflict between the right to the privacy of judges and the freedom of media.
