This paper looks at the context of the human rights framework on euthanasia in Europe. The goal of this paper is to present the current situation regarding euthanasia in Europe and the European Court of Human Rights, where it will address cases claiming the right to euthanasia. Euthanasia and assisting in euthanasia is the subject of significant legal disputes and conflict across Europe. Some believe that the right to euthanasia is a universal principle of the right to a dignified death, and that euthanasia is therefore morally acceptable, although it does raise the issue of a legal solution. In this sense, some European countries allow euthanasia, while in others it is prohibited. Euthanasia is the humane inducing of death, that is, the mechanism by which a person who is terminally ill is intentionally and consciously put to death to alleviate further pain and suffering. Therefore, it is a method of purposely causing death, where the intentional purpose creates multiple controversies. Legal theory distinguishes between active and passive euthanasia, voluntary and involuntary, and testamentary and forced euthanasia. The act of euthanasia is associated with assisted suicide, which includes the procedure by which the perpetrator assists the victim in committing suicide by providing advice or obtaining funds. As euthanasia is a controversial topic, there are various views on it, such as ethical, theological and medical. A number of international legal instruments, such as the 1948 Universal Declaration of Human Rights, the 1966 International Covenant on Civil and Political Rights and the 1950 European Convention for the Protection of Human Rights and Fundamental Freedoms, define the right to live as a counterweight the right to die, while currently the strongest basis for the right to die, ie for the right to euthanasia, is the 1984 Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
