Abstract
Predmet rada jest rasprava u kaznenom postupku. Obzirom da kazneni postupak u Republici Hrvatskoj pripada mješovitom tipu kaznenog postupka, kao određenoj kombinaciji optužnog i istražnog tipa kaznenog postupka, u kojem nalazimo dva glavna stadija u vidu prethodnog postupka i rasprave, u ovome radu osvrnut ću se na raspravu kao, po meni, najvažniji dio kaznenog postupka. Pri tome će predmet analize biti pripreme za raspravu te njezin tijek i to sve do donošenja same presude. Budući da tijekom rasprave dominiraju najvažnija načela kaznenog postupka u vidu usmenosti, neposrednosti, javnosti, slobodne ocjene dokaza te raspravno načelo, u radu ću se osvrnuti kako na provođenje istih načela, tako i na njihova eventualna ograničenja tijekom kaznenog postupka. Isto tako, u radu ću navesti određene primjere iz sudske prakse, a putem kojih ću analizirati primjenu relevantnih zakonskih odredbi u sudskoj praksi, a koje se odnose na tijek rasprave, prava stranaka na raspravi i na upravljanje samom raspravom.
Abstract (english)
The subject of the work is the hearing in criminal proceedings. Considering that the criminal proceedings in the Republic of Croatia belongs to the mixed type of criminal procedure, as a particular combination of the indictment and investigation type of criminal procedure, in which there are two main stages in the form of pre-trial and trial, in this paper I will draw on the debate as, in my opinion, the most important part of the criminal proceedings. In doing so, the subject of analysis is how to be preparing for the debate and its course and all the way to making a judgment. Because the hearing is dominated by the most important principles of criminal procedure in the form of orality, immediacy, publicity, free evaluation of evidence and trial principle, in the work I'll turn to the implementation of the same principles, but also on their possible restrictions during criminal proceedings. Also, the paper will cite specific examples from case law, and through which I will analyze the application of the relevant legal provisions in case law, which relate the discussion, the rights of the parties at the hearing and to manage the discussion.
