Abstract
Pravo na zaborav jedno je od prava koje jamči Opća uredba o zaštiti osobnih podataka, a smatra se kako je proizašla iz sudske prakse. Riječ je o pravu pojedinca da pod određenim uvjetima zatraži od operatera pretraživača, tj. davatelja usluge pretraživanja Interneta, prestane uvrštavati poveznice s njihovim osobnim podacima na mrežne stranice trećih osoba koje se pojavljuju nakon pretrage po osobnim imenima ispitanika, čak i onda kada je riječ o zakonito objavljenom sadržaju, tj. sadržaju koji nije uklonjen s izvorišne stranice. Ovaj rad nudi pregled temeljnih zakonskih akata koji štite pojedinčevo pravo na privatnost, a poseban se naglasak stavlja na Direktivu 95/46 EZ i spomenutu Opću uredbu. Također, u radu se diferenciraju razlike unutar kontinentalnog i američkog poimanja prava na zaborav te, u kontekstu presuda Suda pravde Europske unije, prikazuje osnovna misao, uloga i značenje prava na zaborav.
Abstract (english)
The right to forget is one of the rights guaranteed by the General Data Protection Regulation and is considered to have arisen from case law. It is the right of an individual to, under certain conditions, request the search engine operator, ie the Internet search service provider, to stop including links to their personal data on third-party websites that appear after searching for personal names, even when it is legal published content, ie content that has not been removed from the source page. This paper offers an overview of the basic legal acts that protect the individual's right to privacy, with special emphasis on Directive 95/46 EC and the aforementioned GDPR. Also, the paper differentiates the differences within the continental and American understanding of the right to forget and, in the context of the judgment of the Court of Justice of the European Union, presents the basic idea, role and meaning of the right to be forgotten.
