Abstract
Računalni programi su kao relativno nova pojava u svijetu tehnologije, ali i u svijetu pojedinca svojim agresivnim razvojem pravnu struku uhvatili nespremnu. 1970-ih i 1980-ih godina vodile su se opsežne rasprave o tome treba li računalne programe štititi u okviru patentnog sustava, autorskopravnog sustava ili nekog trećeg sui generis sustava. Ove rasprave rezultirale su općeprihvaćenim načelom da računalni programi trebaju biti zaštićeni autorskim pravom uz određene prilagodbe ove zaštite značajkama svojstvenim računalnim programima. Autorskopravna zaštita računalnih programa najprije je usvojena u Sjedinjenim Američkim Državama, a isti primjer slijedile su međunarodne organizacije značajne za razvoj i zaštitu prava intelektualnog vlasništva te konačno i Europska unija. Direktiva o pravnoj zaštiti računalnih programa postigla je harmonizaciju na europskom prostoru, pa danas i hrvatski Zakon o autorskom pravu i srodnim pravima definira i uređuje računalne programe na način predviđen ovom Direktivom.
Abstract (english)
Computer programs, as a relatively new phenomenon in the world of technology and in the world of individuals, with their rapid development have caught the legal profession unprepared. In the 1970s and 1980s, there were extensive debates about whether computer programs should be protected under a patent system, a copyright system, or a third, sui generis system. These discussions have resulted in the generally accepted principle that computer programs should be protected by copyright with certain adaptations of this protection to the features inherent in computer programs. The Copyright Protection of Computer Programs was primarily adopted in the United States. The same example was followed by international organizations important for the development and protection of intellectual property rights and in the legal framework of the European Union. Harmonisation was achieved on the European level with The Directive on the legal protection of computer programs of the European Union. Following the guidelines of the Directive, Croatian Copyright and Related Rights Act defines and regulates computer programs in the manner provided by this Directive.
