Abstract Osobe s invaliditetom definiraju se kao one koje imaju dugotrajna tjelesna, mentalna, intelektualna ili osjetilna oštećenja, koja u međudjelovanju s različitim preprekama mogu sprečavati njihovo puno i učinkovito sudjelovanje u društvu na ravnopravnoj osnovi s drugima. Prema procjenama Ujedinjenih Naroda, invaliditet među stanovništvom sve je rašireniji, pa tako od deset stanovnika svake zemlje barem je jedan u određenoj mjeri osoba s invaliditetom. More počinje mijenjati 50-tih godina 20. stoljeća, a od 90-ih godina 20. stoljeća dolazi do isticanja prava osoba s invaliditetom i potrebe njihovog poštivanja kroz međunarodne dokumente od kojih je najznačajnija Konvencija o pravima osoba s invaliditetom iz 2006. godine. U međunarodne izvore prava uvršteno je pravo na sklapanje braka kao modela višestoljetne, običajem i pravom uređene heteroseksualne životne zajednice žene i muškarca. Konvencija o pravima osoba s invaliditetom svim osobama s invaliditetom u dobi za brak jamči pravo da sklope brak i osnuju obitelj na temelju slobodne i potpune suglasnosti na ravnopravnoj osnovi s drugima te im se priznaje i pravo na slobodno i odgovorno odlučivanje o broju djece i o tome kada će ih imati, kao i pravo na pristup informacijama primjerenim njihovoj dobi i obrazovanju vezanom uz reprodukciju i planiranje obitelji te sredstvima za ostvarenje tog prava. Pravni sustav Republike Hrvatske odredbama o sklapanju braka u Obiteljskom zakonu uvažava zahtjeve Europske Konvencije i Konvencije o pravima osoba s invaliditetom. S druge strane, pitanju ostvarivanja prava na sklapanje braka osoba s duševnim smetnjama lišenih poslovne sposobnosti važno je pristupiti vrlo pažljivo i obzirno, te to pravo ograničiti samo u iznimnim slučajevima. Abstract (english) People with disabilities are defined as those who have long-term physical, mental, intellectual or sensory impairments, which, in interaction with various obstacles, can prevent their full and effective participation in society on an equal basis with others. More attitude towards people with disabilities began to change in the 1950s, and from the 1990s, the rights of people with disabilities were emphasized and the need to respect them through international documents, the most significant of which is the Convention on the Rights of Persons with Disabilities from 2006. International sources of law include the right to marry as a model of a centuries-old heterosexual union between a man and a woman governed by custom and law. The Convention on the Rights of Persons with Disabilities guarantees all persons with disabilities of marriageable age the right to marry and to found a family on the basis of free and complete consent on an equal basis with others, and recognizes their right to freely and responsibly decide on the number of children and when they will have them, as well as the right to access information appropriate to their age and education related to reproduction and family planning, and the means to realize that right. The legal system of the Republic of Croatia, with the provisions on marriage in the Family Law, respects the requirements of the European Convention and the Convention on the Rights of Persons with Disabilities. On the other hand, it is important to approach the issue of exercising the right to marry for the persons with mental disorders deprived of business capacity very carefully and considerately, and only limit this right in exceptional cases.
