Abstract
Tema ovog diplomskog rada je uloga javnih bilježnika kao povjerenika suda u ostavinskom postupku. Da bismo mogli razjasniti koja prava i dužnosti u tom postupku pripadaju javnim bilježnicima, prvenstveno je potrebno objasniti sam institut ostavinskog postupka provođenog od strane suda te putem usporedbe ukazati na razlike. Od samih načela nasljednog prava na temelju kojih dobivamo uvid u nasljedno pravo kao jednu od posebnih grana prava koja služi utvrđivanju nasljednopravnih učinaka nastalih činjenicom smrti fizičke osobe, do nadležnosti za rješavanje pravnog predmeta unutar posebnog postupka pokušat ću prikazati što vjerniji uvid u postupanje. Na kraju rada spomenut ću i posebne odredbe Zakona o nasljeđivanju koje se tiču samih javnih bilježnika kao povjerenika suda koje se neće odnositi i na sud kada postupa kao ostavinski sud. Potrebno je spomenuti i Pravilnik u kojem su točno propisane tarife na temelju kojih javni bilježnik kao povjerenik suda u ostavinskom postupku ima pravo na nagradu i troškove.
Abstract (english)
The subject of this graduate thesis is the role of public notaries as a court trustee in probate proceedings. In order to clarify which rights and duties in this process belong to public notaries, it is primarily necessary to explain the institute of court proceeding conducted by the court itself and to compare the differences. From the very principles of inheritance based on which we gain insight into inheritance law as one of the special branches of law that serves to determine the inheritance effects caused by the fact of the death of a natural person, I will try to present the more credible insight into the treatment to the jurisdiction of the legal case within a special procedure. At the end of the thesis I will mention the special provisions of the Law on inheritance concerning the notaries of the public as a court trustee that will not refer to the court when it acts in succession proceedings.. It is also necessary to mention the Rulebook in which the exact tariffs are prescribed based on which the notary public as a trustee in the court proceedings is entitled to the award and the costs.
