The general administrative procedure, regulated by the General Administrative Procedure Act, is conducted for the purpose of recognizing a certain party’s right, protecting a legal interest or imposing an obligation. In this sense, understanding the distribution of parties into active, passive and interested persons is of importance. In the process, such situations often arise where the party, due to impaired health, is not capable of independently reasoning about the circumstances that may be detrimental to them. In such situations, it is allowed to establish a relationship between her and another person who will undertake actions and tasks in her name and on her account, with the same effect as if she had undertaken them herself. It can be clearly assumed that this regards the institution of representation, that has recently gained more and more importance. However, it is necessary to set certain criteria that the representative should respect so that he does not unknowingly or knowingly take advantage of the client and thereby endanger his well- being. The aim of the final paper is to present how the previously described relationship functions, as well as possible problems that may arise from it. Therefore, in the penultimate part of the work, there is also talk about the Social welfare Institute as a body those competences are precisely the supervision of the proper and legal performance of the guardian´s duties over the ward, but also about the sanctions that may result from established irregularities.
