Abstract U posljednjem desetljeću kriptovalute su postale sveprisutne u financijskom svijetu, stvarajući nove izazove i pravne probleme, posebno u području građanskog prava. Ovaj rad se bavi pravnim aspektima kriptovaluta u kontekstu građanskog prava u Hrvatskoj. U uvodu se postavlja kontekst istraživanja, ističući rastuću popularnost kriptovaluta i potrebu za pravnom regulacijom koja bi omogućila njihovu pravnu sigurnost i stabilnost. Cilj rada je pružiti sveobuhvatan pregled pravnih pitanja koja se javljaju u vezi s kriptovalutama i njihovom primjenom u građanskom pravu. Prvi dio rada pruža opći pregled kriptovaluta, uključujući njihovu definiciju, karakteristike i ulogu tehnologije blockchain. Uz to, prikazat ćemo pregled trenutno dostupnih kriptovaluta sa njihovim pripadajućim karakteristikama. Drugi dio rada se usredotočuje na pravni okvir kriptovaluta u Hrvatskoj. Analizira se postojeći zakonski okvir i regulatorni pristup, uključujući relevantne zakone i propise koji se primjenjuju na kriptovalute. Također se istražuje sudski pravni okvir i praksa vezana uz kriptovalute u Hrvatskoj, kao i regulatorni stavovi izraženi od strane nadležnih institucija. Treći dio rada istražuje specifične pravne aspekte kriptovaluta u kontekstu građanskog prava. Uz to, razmatra se primjena odredbi građanskog prava na kriptovalute, uključujući prava i obveze korisnika kriptovaluta. Četvrti dio rada se bavi zaštitom potrošača u kontekstu kriptovaluta. Analiziraju se regulatorna tijela i njihova uloga u zaštiti potrošača pri korištenju kriptovaluta. Također se razmatra pravni okvir za izdavanje i trgovanje kriptovalutama, s posebnim naglaskom na zaštitu investitora i prevenciju prijevara. U petom dijelu rada se identificiraju izazovi i nedostaci trenutnog pravnog okvira vezanog uz kriptovalute u Hrvatskoj. Kriptovalute, kao digitalne valute temeljene na tehnologiji blockchain, predstavljaju novi oblik imovine s posebnim karakteristikama. Kroz analizu postojećeg stanja, autor identificira izazove i nedostatke u regulaciji te daje preporuke za unapređenje pravnog okvira. Cilj je pružiti sveobuhvatan uvid u kriptovalute i građansko pravo u Hrvatskoj, te razmotriti perspektive i buduće pravne izazove u ovoj dinamičnoj oblasti.
Abstract (english) In the last decade, cryptocurrencies have become ubiquitous in the financial world, creating new challenges and legal issues, especially in the field of civil law. This paper explores the legal aspects of cryptocurrencies in the context of civil law in Croatia. The introduction sets the research context, highlighting the growing popularity of cryptocurrencies and the need for legal regulation to ensure their legal security and stability. The objective of the document is to offer a thorough examination of the legal challenges that emerge concerning cryptocurrencies and their utilization within the domain of civil law. The first part of the paper provides a general overview of cryptocurrencies, including their definition, characteristics, and the role of blockchain technology. Furthermore, we will present an overview of currently available cryptocurrencies along with their corresponding characteristics. The second part of the paper focuses on the legal framework of cryptocurrencies in Croatia. The existing legislative framework and regulatory approach are analyzed, including relevant laws and regulations that apply to cryptocurrencies. The judicial framework and practices related to cryptocurrencies in Croatia, as well as regulatory perspectives expressed by competent institutions, are also explored. The third part of the paper investigates specific legal aspects of cryptocurrencies in the context of civil law. Additionally, the application of civil law provisions to cryptocurrencies, including the rights and obligations of cryptocurrency users, is considered. The fourth part of the paper addresses consumer protection in the context of cryptocurrencies. Regulatory bodies and their roles in protecting consumers when using cryptocurrencies are examined. The legal framework for issuing and trading cryptocurrencies is also discussed, with a particular emphasis on investor protection and fraud prevention. The fifth part of the paper identifies challenges and shortcomings of the current legal framework related to cryptocurrencies in Croatia. Cryptocurrencies, as digital currencies based on blockchain technology, represent a new form of asset with unique characteristics. Through an analysis of the current situation, the author identifies challenges and shortcomings in regulation and provides recommendations for enhancing the legal framework. The objective is to offer a comprehensive comprehension of cryptocurrencies and their interaction with civil law in Croatia, while also contemplating various viewpoints and anticipated legal obstacles in this rapidly evolving domain.
