Abstract Namirenje vjerovnika u okviru stečajnog postupka moguće je obaviti ili diobom unovčene stečajne mase, i to tako da se razmjerno utvrđenim tražbinama vjerovnika isplate odgovarajući iznosi, ili na način da se na njih prenese neunovčena stečajna masa. Dioba unovčene stečajne mase može se izvršiti i putem nekoliko djelomičnih dioba te jednom završnom diobom nakon koje pak, pod određenim uvjetima, postoji mogućnost provedbe naknadne diobe. Vjerovnicima se u ovom postupku smatraju sve one osobe koje imaju bilo kakvu tražbinu prema stečajnom dužniku, a njihove se tražbine definiraju rješenjem o utvrđenim tražbinama nakon prijave stečajnom upravitelju. Vjerovnici se mogu podijeliti u nekoliko kategorija, ovisno o tome kakvu tražbinu imaju prema stečajnom dužniku, a o tome će ovisiti ima li određeni vjerovnik pravo prvenstvenoga namirenja. Redoslijed namirenja vjerovnika stečajnog dužnika zakonski je uređen te se provodi svrstavanjem pojedinih vjerovnika, odnosno njihovih tražbina, u određene isplatne redove pri čemu viši isplatni red uvijek ima prednost namirenja nad nižim isplatnim redom. S druge strane, vjerovnici koji pripadaju istom isplatnom redu, namiruju se razmjerno veličini njihovih potraživanja koje imaju prema istom stečajnom dužniku. Osim namirenja primjenom navedenih načina u okviru stečajnog postupka, postoje i posebna pravila o prijeboju tražbina prema stečajnom dužniku i o cesiji takvih tražbina, što predstavlja iznimku od pravila da vjerovnici svoje tražbine mogu ostvariti isključivo tijekom stečajnog postupka. Usto, kako bi se zaštitila prava radnika kojima je uslijed stečaja poslodavca ugrožena socijalna sigurnost, pojačana je i zaštita radničkih tražbina u slučaju stečaja njihova poslodavca.
Abstract (english) Settlement of creditors in a bankruptcy procedure can be carried out either through the division of liquidated bankruptcy estate, videlicet the appropriate amounts are paid proportionally to the established claims of creditors, or through the transfer of unliquidated bankruptcy estate to them. The distribution of the liquidated bankruptcy estate can also be carried out through several partial divisions and one final division after which, under certain conditions, there is even a possibility of carrying out an ex-post division. Creditors in this procedure are considered to be all persons who have a claim of any nature towards the bankruptcy debtor and their claims are determined by issuing a decision on established claims after they have been reported to the trustee in bankruptcy. Creditors can also be divided into several categories, depending on the nature of the claim they have towards the bankruptcy debtor, based on which it is decided whether a creditor has the priority right of settlement. The order of settlement of a bankruptcy debtor’s creditors is regulated by law, and it is carried out in such a way that each individual creditor, i.e. their claims, are classified in a certain ranking of claims, where the higher ranking of claims always has the priority of settlement over the lower ranking of claims, whereas creditors given the same ranking of claims are settled proportionally to the amount of their claims. In addition to settlements via the aforementioned methods within the bankruptcy procedure, there are also special rules concerning the set-off of claims towards the bankruptcy debtor and the cession of such claims, which is an exception to the rule that creditors can only realize their claims during the bankruptcy procedure. Furthermore, the protection of workers' claims in the event of employer bankruptcy has been strengthened with the aim of protecting the rights of workers whose social security is threatened as a consequence of their employer’s bankruptcy. the rights of workers whose social security is threatened as a consequence of their employer’s bankruptcy.
