| Abstract | Tema ovog diplomskog rada je ostavinski postupak, koji je izvanparnični postupak na koji se primjenjuju odredbe Zakona o parničnom postupku. Pokreće se povodom smrti svake osobe, a zatim ga se vodi kako bi se zaštitila prava koje nastaju kao posljedica smrti osobe. U ostavinskom postupku se utvrđuju ostaviteljevi nasljednici, što sve čini njegovu ostavinu, te koja prava u vezi s ostavinom pripadaju nasljednicima, zapisovnicima i drugim osobama. Subjekti ostavinskog postupka su stranke postupka i tijela koja ga provode. Tijela ostavinskog postupka su ostavinski sud i javni bilježnik kojemu je povjereno vođenje ostavinskog postupka. U radu je razrađen sam proces pokretanja postupka, njegova načela i pravila određivanja nadležnosti. Tijek ostavinskog postupka u radu je obrađen detaljno kao i sama ostavinska rasprava, koja predstavlja središnji i glavni dio ostavinskog postupka. Tijekom postupka, radi zaštite prava stranaka i drugih osoba koje polažu prava na ostavinu, mogu se određivati različite mjere osiguranja koje su dio ostavinskog postupka, te su navedene u radu i analizirane. Nakon okončanja ostavinskog postupka, sud, ovisno o okolnostima, donosi neko od rješenja kojima će odlučiti o pravnom sljedništvu koje je nastupilo zbog ostaviteljeve smrti, sveukupni naziv za ta rješenja je - rješenja o nasljeđivanju. |
| Abstract (english) | The core focus of this thesis centers on the inheritance procedure, a non-litigious process subject to the regulations stipulated by the Civil Procedure Act. Initiated upon the demise of an individual, this procedure is conducted with the intention of safeguarding the rights that emerge consequent to a person's passing. Within the inheritance procedure, the beneficiaries of the testator are ascertained, the composition of their estate is delineated, and the entitlements connected to the estate are defined for the heirs, legatees, and other pertinent individuals. Central to the inheritance procedure are the participants engaging in the process and the entities overseeing its execution. The inheritance court and the appointed public notary collectively constitute the operational components of the inheritance procedure. This thesis comprehensively explores the initiation process, the guiding principles, and the jurisdictional regulations governing the inheritance procedure. Additionally, the detailed course of the inheritance procedure, including the pivotal inheritance discussion, which constitutes its core and pivotal aspect, is expounded upon. Throughout the procedure, an array of protective measures might be established to ensure the rights of the involved parties and other individuals asserting claims to the estate. These security measures, integral elements of the inheritance procedure, are meticulously outlined and analyzed within this work. Upon the conclusion of the inheritance procedure, the court, based on the prevailing circumstances, renders decisions that ascertain the legal succession stemming from the testator's passing. Collectively termed as "inheritance decisions," these determinations encapsulate the outcomes of the inheritance procedure. |
