The right of self-defense is based on two principles: principle of self-protection and principle of legal order protection. Self-defense is defined as the right to prevent suffering force or violence through the use of a sufficient level of counteracting force or violence. It can be assumed that self-defense is the reason for the exclusion of unlawfulness so there is no criminal offense. When speaking about unlawfulness, we have to distinguish material and formal unlawfulness. The court of law does not determine material unlawfulness. However, if connection between material and formal unlawfulness doesn't exist, there is a need to determine material unlawfulness. When speaking about self-defense, victim needs to be aware that he is rejecting unlawfull assault. Elements of self-defense are assault and defense. Assault has to be unlawful, simultaneous or direct and imminent while defense has to be necessary. There are limits to what you can do in self-defense. There are two types of exceeding limits of the self-defense: intensive and extensive exceeding. Extensive exceeding exist when assault and defense are not simultaneous so it can not be a self-defense, not even exceeding of limits of self-defense because in that case assault doesn't even exist. Intensive exceeding of limits of self-defense is situation in which assaulted applies defense that is not necessary and the reason is that assaulted misjudged the force of assault or used greater force then the one threatened.
