The purpose of appeal in criminal procedure is abolishing irregular and unlawful verdict with the aim of removing its possible shortcomings through the action of another, mainly a higher court that would either abolish or modify an existing decision by adopting new, correct and legitimate decisions. This paper begins with the introduction into the term of legal remedies, their development and purpose in the legal system as the basic right of every party in the litigation. The paper further analyses the term and legal nature of the appeal, its form, rights of it, and bases on which it can be lodged, as well as the examples from the case-law. The main advantage of the appeal is the opportunity to request a formal change to an official decision and preventing finality of an unfounded conviction and irregular judicial punishment, and in the strict sense, the protection of the fundamental rights and freedoms of every person, the preservation of the public interest, but also the preservation of the court's title as the guardian of the justice. The main disadvantage would be the procedural delays which can lead to reduction of the efficiency of courts and weakening of the effectiveness of the penalty system.
