Abstract
U postmodernističkom društvu najveću društvenu polarizaciju izaziva tema pobačaja što se ujedno rezultira određenim implikacijama na pravo koje uređuje pitanje zaštite prava na život i prava na privatnost. Upravo pravo na život nerođenog djeteta i prava na privatnost majke koje je omogućuje pobačaj je predmet spoticanja unutar brojnih struka pa tako i prava. Tom problematikom je pogođena i RH o kojoj je Ustavni sud RH 2017. donio rješenje kojim je odlučio o zahtjevu za ocjenu ustavnosti komunističkog Zakona o zdravstvenim mjerama za ostvarivanje prava na slobodno odlučivanje o rađanju djece koji je dopuštao pobačaj do 10. tjedna trudnoće. Kako problematika zahtjeva interdisciplinarni pristup Ustavni sud se obratio Medicinskim fakultetima s pitanjem kada počinje ljudski život na što su oni jednoglasno odgovorili da počinje začećem. Unatoč odgovoru da ljudski život počinje začećem i shodno tome bi se čl. 21. URH trebao primjenjivati na nerođeno dijete zbog njegove specifičnosti koja uključuje da svako ljudsko biće ima pravo na život Ustavni sud RH je odlučio drugačije. Svojim rješenjem Ustavni sud RH je nerođeno dijete priznao kao ustavnu vrijednost te potvrdio dopuštenost pobačaja do 10. tjedna trudnoće te ostavio zakonodavcu ostavio okvir od dvije godine da donese novi zakon koji će uređivati pitanje pobačaja. Abstract (english)
In the postmodernist society, the greatest social polarization is caused by issue of abortion, which at the same time results in certain implications for the right that regulates the issue of protection of the right to life and the right to privacy. The right to the life of an unborn child and the right to the mother's privacy that allows abortion are the subject of stuttering within a number of professions, including law. The question in a legal context is whether a child can be considered... More as a legal entity or not, and in what way to balance two distinct rights: the right to unborn child's life and the right of the mother to privacy. The Republic of Croatia was also affected by this issue, on which the Constitutional Court of the Republic of 2017 issued a decision, deciding on the request for review of the constitutionality of the Communist Act on Health Measures for the exercise of the right to free decision-making about the birth of children who permitted abortion up to the 10th week of pregnancy. Since the issue demands an interdisciplinary approach, the Constitutional Court addressed the Medical Faculties with the question of when human life begins to which they unanimously respond: with the conception. Despite the answer that human life begins with conception, as accordingly Art. 21. The URH should apply to an unborn child due to its specificity, which includes that every human being has the right to life, the Constitutional Court of the Republic of Croatia has decided otherwise. By its regulation, the Constitutional Court of the Republic of Croatia recognized the unborn child as a constitutional value and upheld the abortion permit until the 10th week of pregnancy and left the legislator a two-year framework to adopt a new law regulating abortion.
